Study On The Permanent Residence System For Foreigners In China

The international communit y has a long tradition of using immigration policies to attract talents in the world,and foreigners have a permanent residence s ystem.The permanent residence system for foreigners is one of them.In order to "attract,retain and make good use of" foreign talents,it is very necessary for China to use open and pragmatic immigration policies to build a platform to attract and develop talents,and the construction of a relatively complete permanent residence system for foreigners is a key step.In 2020,China timely released the "Regulations of the People's Republic of China on the Administration of Permanent Residence of Foreigners(Draft Version)",to a certain extent,the threshold introduced b y foreign talents is reduced,and demonstrate China's sincerit y and determination to continue to expand and open up in the field of immigration.However,there are still man y deficiencies,such as the application conditions are not refined enough,the supporting immigration laws and technical means are not perfect,and weak existing immigration integration mechanism,which lead to loopholes in the legal system of China's permanent residence system for foreigners and gaps in implementation.This paper focuses on the permanent residence s ystem of foreigners,and discusses the permanent residence s ystem of foreigners,research and discuss the theoretical basis of the s ystem,appropriatel y learn from the similar institutional design of non-regional countries,and propose the perfect path of the permanent residence s ystem for foreigners in China,so as to meet the strategic positioning of the system of "gathering talents from all over the world and appl ying them".The paper is mainl y divided into four chapters except the i ntroduction:The first chapter analyz es the theoretical basis and significance of the permanent residence system for foreigners.First of all,the concept of foreigners and international immigrants,permanent residence and permanent residence s ystem is ana l yz ed.Secondl y,it clarifies the fundamental theor y of international law on the permanent residence s ystem,including the national sovereignt y theor y and the theor y of human rights protection.Finall y,it demonstrates the necessit y of the introduction of the "the Administration of Permanent Residence of Foreigners(Draft Version)".The draft is a guide to attract talents,the start of immigration management legislation,and the relative need of international immigration specification.The second chapter conditions for foreigners to appl y for permanent residence,improve the technical means of immigration law with the points evaluation system as the main body,and enhance the integration services for immigrants.On the other hand,we must consummate the accessorial mechanism of the permanent residence s ystem for foreigners in China,including rational use of the s ystem for information management,enhancing the emplo yment management s ystem f or foreigners,and deepening the cooperative mechanism with the International Organization for Migration.
