| The power of accommodation in legislation of SEZs is a special power gra nted by NPC and its Standing Committee, which has great impacts on the devel opment of SEZs, the Reform and Opening and even the economic development of the whole country. This thesis standing on the view of the accommodation in legislation of SEZs tries to induce the characteristics of the power of accommo dation in legislation of SEZs by collecting large number of examples and analy zing them through the method of empirical analysis. The body of this thesis consists of four chapters besides the foreword and the c onclusion:Chapter1briefly introduces the legal basis and the main principles of the power of accommodation in legislation of SEZs. Moreover, the comparison and distinction about the innovation and accommodation of the legislation in SEZs, which stands on the view of legislative practice, is also discussed in this chapt er.Chapter2organizes and sorts the practical examples consisting of the prac tices of the power of accommodation in legislation of SEZs, which includes Sh enzhen, Zhuhai, Shantou, Hainan and Xiamen.Chapter3reflects the practices in the form of table and further concludes t he characteristics, the impacts and the existing problems of the power of accom modation in legislation of SEZs.Chapter4analyzes the application of judicature and policy about the pract ices of the power of accommodation in legislation of SEZs. In addition, it also discusses the contradiction and preference between the practices and the existin g laws. It is believed that the unification of legal system should be subordinate to the overall situation of Reform and Opening. |
