A Research On The Problems Of The Law Of The Republic Of Kazakhstan On Special Economic Zones

Due to constant development of the world political and economic pattern,the cooperation of all countries in the world is becoming increasingly closer.China become an important part of the world pattern,which policy impact on the world economy.Chinese president made a speech at Nazarbayev University in 2013,put forward the concept of building a Silk Road economic belt with innovative cooperation mode.Kazakhstan as one of the most important countries on the Silk Road,intends to pursue a more proactive policy to the economic and cultural development.To take this opportunity,the special economic zones of Kazakhstan can be greatly developed.Although the Kazakhstan special economic zones had been founded earlier,the early stage of development was relatively slow.The main reason is that the national special economic zones legal mechanism is far from ideal,at the stage of exploration.But in the later stage it's development is quite a bit quick so that the special economic zone law in Kazakhstan becomes relatively sound,but compared with other countries,there is a long way to go.Based on Kazakhstan's present development level and other country's development experience,this thesis makes an attempt to explore the better ways to develop Kazakhstan's special economic zone law,based on these we hope that the special economic zone will have a better development.This paper mainly uses the method of literature analysis and comparative analysis.By consulting the present situation of the development of the Kazakhstan special economic zone and combining with his understanding of the Kazakhstan,the legal problems of the law of the special economic zone of Kazakhstan are found.It is mainly embodied in two aspects of legislative and implementation issues.Then by consulting the development experience of various special economic zones and the laws regulations of special economic zones,we compare the development status of the special economic zones in Kazakhstan and the laws regulations of the special economic zones,and put forward suggestions for solving the problems,as well as our own thinking.During the research,we found that the main problems in the legislation of the Kazakhstan Special Economic Zone are the gaps and blanks of law,the reunion of functions of government's management department,the poor operability of the legalsystem.With regard to the gaps and blanks of law,it can be complemented on the legislative experience of other countries.As to the reunion of functions of government's management department,it is proposed that we should scientifically delineate the legal boundaries of government functions.Aiming at the poor operability of the legal system,we hope that the legislative branch can personally investigate it in order to make the law more effective.The special economic zones law has three main problems in the enforcement of its law: low efficiency,corruption and limitation of attracting foreign capital.The paper puts forward corresponding suggestions for these three points.In addition,it also pays more attention to analyzing the construction experience of China's special economic zones and its enlightenment to Kazakhstan.We hope that it will have a certain reference value to the construction of the law of Kazakhstan's special economic zones.
