Research On The Accommodation Power In Legislation Of Shenzhen Special Economic Zone

In the past 27 years since Shenzhen special economic zone was vested with special zone legislative power,the social and economic situation herein has undergone a historic change and Shenzhen has made great achievement in its modernization construction.Shenzhen has become the window and experimental field of the reform and open-up policy of China,and the model of the Five-point Strategy of the new era.These achievement is closely linked with the creation of the special zone legislation.However,at the same time,this special legislative power is facing challenge and controversy.How to balancing the inner harmony between the special economic zone legislative power and the whole legislative system and the innovation function of this power is a important legal issue.This paper consists of four chapters.In chapter 1,the fundamental theory of Shenzhen special economic zone legislative power is discussed.The major contents in this part include the different between districted city legislation and special economic zone legislation and the source,scope and level of special zone legislation power.In chapter 2,the conception of accommodation legislative power is discussed,including the semantic and theoretical analysis.The chapter 3 discusses the issue that the special accommodation legislative power whether should be abolished or not.This part tries to point out the accommodation power is the essential feature of the special zone legislative power,and it is necessary and proper for the economic or non-economic fields development of the special zone.The chapter 4 discusses the practices of special zone legislation power.Following its history,this part analyzes the problems of the accommodative legislation,and presents some specific solutions aiming for more institutionalized legislative power,including more effective filing and inspection procedures,legislative mechanism leaded by the people’s congress and public participation in legislation.
