The Latest Development And Legislative Research Of Special Economic Zone

This dissertation expatiates on the origin and development of Special Economic Zone (SEZ) first of all. Then it analyses and compares the actuality of SEZ of China and abroad. Independently, it also analyses the distinguishing features of SEZ. In addition, it penetrates into the instauration, operation and development of China's SEZ. Especially, it emphasizes on the legal administration of the instauration, operation and development of SEZ area in China.SEZ has Been set up in the world many years ago, and the foreign countries accumulated many experiences on how to supervise the SEZ and build legal environments for them. On the basis of comprehensive examination of SEZ of China and other countries, combined with experiences learned from bonded logistics areas and other forms of SEZs which have been set up in China, and through the comparison and investigation in details into legal administration mode and provisions about the SEZ, it indicates the characteristics and limitation of China's administration system. At the same time, it emphatically introduces the current laws and regulations with regards to SEZs in China and puts forwards some suggestions.Nowadays, China also gained some experiences from operating SEZs, and some new forms SEZ are also emerging. Moreover, China has entered into the Word Trade Organization in 2001, and under China's commitment to WTO, the laws and regulations in certain fields have to be revised or amended to accommodate themselves with the WTO's rules. As a result, consummate the existing legal administration system is imperative under the situation.Significantly, I have made a result as Charter Four i.e. The Legislative Suggestions about Consummating Legal Administration System on SEZ of China. There is a preliminary discussion about the existing supervision mode of China's SEZ and how to establish and complete the system of legislation in China including the selection of legislation mode. Moreover, the paper also gives a tentative plan of the mode which the SEZ should be in the future. In the light of legislative defects in administration system of SEZ in China, the paper tries to provide a suggestion to consummate it. Besides, the paper also deals with how to perfect the laws and regulations in fields related to bonded areas and logistics areas in order to accelerate the development of SEZ in China.
