| Since 1992, Shenzhen Special Economic Zone’s legislative power has through more than20 years. During more than 20 years, Shenzhen played a leading, exploratory role and made the best of Special Economic Zone’s legislative power that not only provided juridical guarantee for the development of Shenzhen, but also accumulated experiences for national legislations. However, in practice, owing to the NPC Standing Committee’s authorization decision not quite clear stipulated the jurisdiction of Shenzhen Special Economic Zone’s legislations, some specific legislations are so controversial, combined with the current theoretical circles in the study on fundamental theory of Shenzhen Special Economic Zone’s legislations deficiencies. With social transformation becoming a potent force, Shenzhen Special Economic Zone’s legislations continuously face challenges. In order to fully understand Special Economic Zone’s legislative power, the practice of Shenzhen Special Economic Zone’s legislations and make Shenzhen regulate the exercise of Special Economic Zone’s legislative power, this article will completely review the practice of Shenzhen Special Economic Zone’s legislations, research the theory of Special Economic Zone’s legislative power and take a look at the possible development of Shenzhen Special Economic Zone’s legislations.This dissertation is divided into three chapters. The first chapter research the fundamental theory of Special Economic Zone’s legislative power. Analysis of Special Economic Zone’s legislative power’s traceability, property, jurisdiction, the differences with cities divided into districts’ legislative power and application. The second chapter completely review the practice of Shenzhen Special Economic Zone’s legislations, enumerate Shenzhen Special Economic Zone’s legislations which breach of the epistatic laws’ rules and fill the legal gaps, explore the innovations and laws of Shenzhen Special Economic Zone’s legislations, combs through the disputes about reserving or abolishing, jurisdiction of Special Economic Zone’s legislations,add that the problems with Special Economic Zone’s legislations. The third chapter look to Shenzhen Special Economic Zone’s legislations, propose Special Economic Zone’s legislations’ existence is necessary. It’s necessary to definite the jurisdiction of SpecialEconomic Zone’s legislations. Lastly, issue recommendations to improve the power operation system of Special Economic Zone’s legislations. |
