"Belt and Road" is an important strategy for China to communicate with more than110 countries and more than 61 international organizations to improve the level of trade facilitation and promote the orderly development of global trade,among which customs clearance convenience is the main link.The formal entry into force of the Agreement on Trade Facilitation in 2017 further highlights the urgent need of social development for customs clearance facilitation.However,in the construction of customs clearance facilitation,the problem of vague powers and powers,which is not high in accordance with the law,is exposed,and as a result,the problem of unclear identification of infringement,unclear procedures and vague rights and responsibilities in customs enforcement is caused by the lack of clarity in the identification of infringement,the unclear procedures and the ambiguity of powers and responsibilities.The three major problems of unclear tortious entity and rigid procedure have become the serious hindrance to the construction of customs clearance facilitation.Starting from the current situation of customs enforcement,this paper explores the rational allocation of customs enforcement powers,entities and procedures through empirical analysis combined with the theoretical guidance of jurisprudence and economics of law,and on this basis,This paper puts forward the improvement direction of customs law enforcement under the convenience of customs clearance,provides reasonable countermeasures and suggestions for the development and modernization of our customs law enforcement system,facilitates the innovation of theory and practice of our customs,and speeds up the process of customs clearance facilitation.
