Online shopping has gradually become part of Chinese people's daily life.With the rise of third-party payment which aims to diminish the concerns over credit guarantee between consumers and merchants,we are witnessing a dramatic increase in online trading volume.However,together with the rise of third-party payment are some deficiencies in the supervision system and the lack of effective regulatory.This includes the supervision of access to and exit from the third-party payment market,the supervision of consumer rights protection,and the supervision of funding pool.The sustainable development of the third-party payment platform will be hindered if no work is done to improve or establish the supervisory system and to address the existing problems.Therefore,this author purports to address aforementioned problems with the current system and provide some solutions to these problems,from both theoretical and practical perspectives.This thesis is divided into five parts:(1)the first section provides a brief introduction to the role the third-party payment plays in people's daily life.Since the Chinese government starts to pay attention to the potential legal risk in the development of this industry,it is of great importance to improve the supervisory system;(2)Chapter 1 aims to analyze some typical cases regarding the third-party payment platform under current legal framework of third-party supervision;(3)Chapter 2 scrutinizes the third-party supervision from the perspective of access to and exit from current third-party payment system,and provides some suggestions for improvement;(4)Chapter 3 deals with some practical legal issues with regard to consumer rights protection in third-party payment activities.The analysis includes the safety of funds account,the safety of personal information,and consumers' right to be informed;(5)Chapter 4 offers an overview of the existing laws regarding the deposit funds in the third-party payment agencies and the status quo of legal problems;it also learns from foreign supervisory system and tends to get some useful experience;(6)Finally,this author concludes the thesis with some legislation suggestions to improve the third-party payment supervisory system.
