Research On The Risk Of Driverless Vehicles And Its Legal Regulation

The rapid development and application of artificial intelligence technology has made the driverless car,which was originally a science fantasy,quietly become a reality.While it is possible to provide safety and convenience to humans,the application of driverless cars also has some unavoidable risks.Since the beginning of this century,the world's major developed countries and technological powers have been strengthening the development and promotion of technology related to driverless cars,and have carried out some legislative explorations in the field of driverless cars.In comparison,although China has introduced some regulations and administrative normative documents for driverless cars,the laws and regulations are still blank.Many problems that may arise after the widespread application of driverless vehicles are bound to exert tremendous pressure on China's "Road Traffic Safety Law" and other related laws.This paper comprehensively uses the methods of literature research,empirical research and comparative analysis to focus on the legal regulation of highly automated driverless cars under the internationally accepted automation level.Firstly,it analyzes that the driverless car brings convenience to human beings,and it contains technical risk,network risk,institutional risk and social risk because of its own intelligence and autonomy.Secondly,based on the source of risk,the necessity of regulating the negative impact of the modernity of driverless vehicles and the positive significance of the legal regulation of driverless vehicles for the construction of modern risk social legal order are derived.Finally,combined with the advanced legislation of foreign countries,the countermeasures and suggestions for the regulation of driverless cars in China are put forward,including: based on the legal regulation concept of science and technology in China and the legal norms of road traffic safety,the establishment is based on maintaining road traffic order and improving road traffic safety.The concept of unmanned car regulation with the core of improving efficiency;under the guidance of the concept of regulation,it follows the basic principles of combining legal regulation with technical norms,coordinating public interest and individual rights,and balancing efficiency and safety;implementing government plus enterprises Regulatory mode;establish and improve the road safety driving system for driverless vehicles;establish a license and quality management system for driverless vehicles;set up a specialdriverless car number plate and driver's license system;establish and improve the liability for damage caused by driverless cars and The insurance system clarifies the main body of responsibility for road traffic accidents of unmanned vehicles,the principle of liability and the main body of law enforcement,including unmanned vehicles in the scope of motor vehicle insurance,expanding the beneficiary body,A new scheme is proposed for the division and identification of tort liability after a traffic accident in a driverless vehicle,and the no-fault liability for damage to passengers in the civil aviation field is introduced to the driverless car,adjusting the compensation ratio,increasing the compensation amount,and implementing the personnel inside the vehicle.Injury insurance system.
