Research On The Issues Of Legal Assistance For The Losing-single-child Family In China

Faced with the soaring population and the continuous increase of the fertility rate,in order to solve a series of social and economic problems caused by the rapid population growth,China put forward the family planning policy in the late 1970 s and began to strictly implement it as a basic national policy nationwide.Since then,the family planning policy has become a special policy unique to China.With the strict implementation of the family planning policy,China's economic development,social progress and people's living quality have been improved.However,the family planning policy that ever been considered greatly benefits the country and the people,gradually exposed some problems in the implementation process over the past years.To some extent,the implementation of the family planning policy leads to the emergence of the single-child family,and further leads to the emergence of the losing-single-child family.As a special group which cannot be ignored in the society,the losing-single-child family has many problems in the field of living guarantee,mental health,medical treatment,endowment insurance and so on.Therefore it is necessary to give enough care and relevant assistance to this special social group.However,it is difficult to find a specific law or regulation on legal assistance for the families who have lost their only child via reviewing the existing laws and regulations and relevant institutional provisions.It can be said that there is a big law and regulation black on legal assistance for losing-single-child family,which should be highly valued by the state and society.This paper analyses the issues of legal assistance for the losing-single-child family in China through four parts.The first part mainly introduces the concept,characteristics and related problems of the losing-single-child family,and generalizes the reasons of the losing-single-child family occurs,and shows the current situation of losing-single-child family in China.The second part mainly expounds the theoretical basis of legal assistance for the losing-single-child family and makes an overall analysis of the existing problems in the legislation.The third part compares the legal assistance system of similar families in foreign countries with the legal assistance system of the losingsingle-child family in China,and draws lessons from relevant good systems and measures.The fourth part puts forward some specific suggestions on the promotion of the legal system of China's legal assistance for the losing-single-child family based on the first three parts.According to this paper,in the current and foreseeable period,the single-child family model is still the most important family structure model in China,and the number of losing-single-child families will continue to increase.Therefore,it is urgent to effectively protect the losing-single-child families through improving the legal system and strengthening the application of legal means,which is also an important content of promoting China's economic development and harmonious society establishment.
