Research On The Application Of Electronic Litigation In The Civil Field

Applying modern information technology to litigation is a great attempt and a beneficial exploration of judicial activities.In civil litigation,we should pay attention to the communication between the parties and the judge,so as to promote the smooth proceeding of the litigation process.Therefore,the application of electronic litigation in the civil field has stronger operability,and the effect will be more obvious.Although China's electronic litigation started late,it has achieved good results so far.Both the full-course electronic litigation and the phased application have brought good experience for litigants.However,the application of electronic litigation is still in the exploratory stage,and it has not yet formed a set of comprehensive and systematic system regulations.In addition,it has some conflicts with the basic principles of civil litigation,and may even becomes a new challenge to the traditional civil litigation.Of course,we should also realize that the application of electronic litigation can not only facilitate litigants to carry out litigation,but also ensures the realization of fairness and justice while efficiently solving disputes.Therefore,it is necessary to analyze the difficulties faced in the current application process of electronic litigation,and then find out the corresponding solutions.There are five parts in this paper.The first part discusses the legitimacy of electronic litigation in the civil field.The second part is the current situation of electronic litigation in the civil field of our country,which is divided into two aspects: system level and judicial practice.The third part,starting from the two dimensions of system design and the practice operation,has analyzed the electronic lawsuit in the application process to meet the difficult position.The fourth part analyzes the causes of the dilemma in order to seek the corresponding countermeasures.The fifth part puts forward suggestions for the improvement and development of electronic litigation in the civil field.In order to perfect the system design of electronic litigation,it is necessary to construct the legal system of electronic litigation from a systematic perspective and adopt a low-cost legal interpretation path.In order to improve the operability of electronic litigation,it is necessary to innovate the concept and make use of the construction of smart courts.
