On The Protection Of Victims’ Rights In Juvenile Crime

Several high-profile juvenile crimes spawned public anxiety and led to discussions of victims of juvenile offenders.There are four characters of victims who was offended by juvenile:(1)most of the victims are themselves under 18 years old,(2)most of them suffered violence and property loss,(3)most of them are hard to get restitution from the offender,(4)victims’ rights was undermined in specific procedures for Juvenile Criminal Cases.On the basis of the characteristics and needs of victims who were offended by minors,the author will deeply analyze their rights in China,and propose several method to help the juvenile judicial reform.In the introduction,the author will firstly introduce the background of this paper,and hold the opinion that victims in juvenile delinquency have been neglected both in legislation and judicial practice.Then,the author will divide this article into five sections.The first section introduces the object and analyze the distinctions between victims who were offended by minor and by major.Section two introduces the theoretical foundation of the protection of victims’ rights in juvenile crime.In this section,the author hold the opinion that the principle of human rights protection and the principle of equality for all illustrate that victims have rights to be protected naturally,when state organs take their responsibility of prosecution,they must maintaining the balance between the protection of victims’ rights and public interest.This section will further explain how the philosophy of rehabilitation would help protecting the rights of victims of juvenile crimes.The third section shows that the increasing concern for the plight of victims in juvenile cases has driven many countries to improve their treatment,and some of their experience,such as legislation,compensation system,relief system,will provide important lessons for our country.The fourth section more closely examines the treatment of victims in juvenile crime by analyzing there needs,including the needs for financial assistance to ameliorate the consequences of crime,the need for punishment of the offender,and the need for security improvement.Lastly,section five will explore the future agenda,including perfect the victim-offender mediation system,the conditional non-prosecution system,and the victim assistant system.This section also calls for more special measures to protect victims under 18 years old.
