Recently,kindergarten child abuse incidents have been frequently exposed to major mainstream media,which has aroused widespread concern from public opinion.The prevention and treatment of child abuse in kindergartens is a problem worthy of discussion in the legal field.It is necessary to regulate the child abuse in kindergartens through legislation.At this stage,China's laws and regulations on the prevention and treatment of child abuse in kindergartens can be divided into two categories.First,the legislation to prevent child abuse in kindergartens is aimed at preventing the occurrence of abuses through legal norms before the occurrence of abuse.Second,assistance Relief legislation for abused children aims to provide relief work for the protection of child welfare after the occurrence of abuse.The remaining problems in China's current legislation include the following: the meaning of abusive behavior in kindergarten is unknown,the standard of child abuse in kindergarten is unknown,the compensation system for mental damage of child abuse has not been established,the blacklist system for child abusers is in the form,and the reporting system is imperfect.The identification criteria for the injured children are unreasonable.Referring to countries with advanced legislation represented by the United States and Japan,through comparative research methods,the enlightenment of improving the prevention and treatment of child abuse in kindergartens in China can be clarified:the criteria for the crime of child abuse in kindergartens,the establishment of compensation system for children's mental damage,and the improvement of blacklists.Institutions,improve the reporting system,and establish reasonable standards for the identification of young children's injuries.
