At present,in the agricultural problems in some areas of our country, the phenomenon of peasant land disputes is becoming more and more common.According to relevant data, land disputes have become a key issue affecting rural governance, such as mishandling can easily lead to rural mass events, and even lead to casualties, resulting in bad social impact. Therefore, this study focuses on the problems of land disputes in rural areas, focusing on how farmers respond to land disputes and the factors that affect them, which is conducive to a better understanding of the actual needs of farmers in the process of safeguarding their rights and interests. We will safeguard the immediate interests of farmers, improve rural governance, improve social management capabilities, and promote the stable development of rural areas. This paper uses the methods of literature analysis and questionnaire survey, and takes Maslow's demand level theory, planning behavior theory, and social capital theory as the basis for research, and collects large sample data through field research and household interviews. The paper combs the status quo of rural land disputes, the choice of land dispute resolution methods and the factors that affect farmers 'choice of land dispute resolution methods, and divides land disputes into village land disputes and land disputes between villagers and village committees or between enterprises.Land dispute resolution is divided into four channels: "inaction","administration","judicial" and "private settlement".Then,on the basis of the literature summary and theoretical analysis, the paper constructs a theoretical analysis framework of the farmers 'choice of land dispute resolution methods, and selects three factors: social capital, land tenure awareness, and past land dispute experiences. It is believed that these three factors may be the key factors that influence farmers 'willingness to choose land dispute resolution, and the mlogit regression model is used for empirical measurement. This article draws the conclusion: First, the rural land dispute happens more frequently. The incidence of land disputes between villagers and village committees or among enterprises was 17.22 %,and the incidence rate of land disputes between villagers and villagers or among enterprises was 10.21 %,which is basically the same as the incidence rate of rural land disputes found by other researchers.Second, when different types of rural land disputes occur, there are differences in farmers 'willingness to choose the way to resolve land disputes. When faced with land disputes among villagers, farmers are more willing to choose "administrative" channels to protect their rights and interests. When faced with land disputes between villagers and village committees or between enterprises, more farmers are willing to choose "inaction." At the same time,it is found that in the two types of land disputes, farmers 'willingness to choose "judicial" channels is not strong.Third, the social capital, the knowledge of land ownership and the experience of land disputes in the past are the main factors that affect the choice of land dispute resolution methods among villagers, and also the main factors that affect the choice of land dispute resolution methods between villagers and village committees or between enterprises.According to the above conclusions, the author puts forward corresponding countermeasures and suggestions: paying attention to farmers 'past dispute experiences and reducing the incidence of land disputes; To enhance the village cadres 'role cognitive ability and strengthen the village cadres team construction; We will improve the rural public legal service system and guide farmers to enhance their sense of usage;Deepen the reform of the rural land system to improve the farmer's ability to recognize the ownership of land;We will establish a moral restraint mechanism for good governance and strengthen the flexible management of good governance.
