Research On Legal Regulation Of Urban Occupied Parking In China

With the rapid development of China's economy,vehicle ownership of urban residents is growing rapidly,but the construction of parking facilities is far behind the traffic demand.As the manager of social public resources,local governments and their occupied parking management departments carry out reasonable and orderly occupied parking management.However,the administration inevitably faces a serious of risks.The contradiction between supply and demand of urban parking is becoming increasingly prominent in China,more and more city appeared serious random stop,misplacing phenomenon,which not only aggravated urban traffic congestion,but also resulting in the parking disputes are increasing.A large number of new motor vehicles can not find suitable parking location in the city center and use various spaces to park.Occupied parking management has become a hot social concern of the government,vehicle owners and the media.As a kind of social public resources,under the pattern of legalization of national governance,taking the practical problems existing in social life as the breakthrough point,aiming at proposing and perfecting the relevant supporting purposes of road parking space management and parking fees,this paper analyses the basic theory of occupied parking through the research background of occupied parking,found the legal system of urban road-occupied parking in China,referring to the experience of parking management in foreign cities,and puts forward the perfect countermeasures for the legal system of urban occupied parking in China.As a socialist country with legal system,the formulation of laws is constantly revised and improved according to the problems reflected in social life.Therefore,when the legal issues of occupied parking are becoming increasingly prominent,we hope this thesis can give enough attention to the relevant departments,establishing and improving the relevant legal system of road-parking management to protect the legitimate rights and interests of the public.
