The Research On Record Review System In Provincial People's Congress

The record review system is a constitutional system in our country.It is unique and irreplaceable in terms of maintaining the unification of national legal system;supervising government to administrate according the law;protecting the legal interest of citizen and legal person.Marked by the legislative law which was passed in 2000 and supervision law which was passed in 2006,the record review system,that grows out of nothing,from coarse to fine,makes a great progress on systematism.Meanwhile,along with the continuously developing of record review system in each provincial people's congress,there are also quite a lot of difficulties and confusions.Among these,there are questions in basic theory level,questions in operation level,as well as questions in system design level.People in theoretical cycle ever made study and research on it,but the research is not systematic and complete.This article is aiming to stick the questions as the guide,by combing the basic conception,operating mechanism and investigation mechanism of the record review system,together with the analysis of real case in some record review in provincial people's congress,thus exploring a path to solve the questions and giving method and advice to perfect the record review system in provincial people's congress.This article is divided into 4 parts.In introduction,I introduce the background of record review system in our country,the research situation at home and aboard as well as the purpose and method of research of this article.In chapter one,I discuss the problems existing in each segment of record review system in provincial people's congress,also analyze the reasons.In chapter two,by the analyzing on some real case on regulation,decisions by standing committee of NPC and record review on other regulating document,reflect the problems in operation.In chapter three,I raise the specific measures and advice to perfect the record review system in provincial people's congress.In conclusion,I give a brief recap on how to perfect the record review system in provincial people's congress,also raising a hope on the role that record review system will play in the future.
