An Empirical Research On The Grass-roots Legal Aid System In China

Legal aid system is an important guarantee to realize the equality of citizens before the law.It is an important criterion to measure whether a country's rule of law is sound or not and whether its human rights protection mechanism is perfect.Since Xiao Yang,former Minister of Justice,first proposed the establishment and implementation of China's legal aid system in 1994,China's legal aid system has undergone nearly 25 years of development and has undergone a sharp change from scratch.The Fourth Plenary Session of the Eighteenth Central Committee pointed out that we should build a complete legal service system and improve the legal aid system.The Nineteenth National Congress of the Communist Party of China stressed that we should deepen judicial reform,fully implement the judicial responsibility system,and strive to make the people feel fair and just in every judicial case.Since 2017,the Ministry of Justice has determined the general idea of accelerating the construction of the public legal service system and effectively enhancing the sense of access,happiness and security of the people.The new era background provides new opportunities for the development of legal aid.Grass-roots legal aid is at the end of the legal aid system,which can better and more directly reflect the problems existing in the legal aid system.From the perspective of grass-roots legal aid,this paper uses empirical research methods to study the problems of grass-roots legal aid system.Through the analysis of the problems at different levels,this paper puts forward some pertinent countermeasures from the aspects of perfecting legislation,strengthening the guarantee of funds and personnel,and strengthening the quality supervision of cases.It is emphasized that the construction of public legal service system should be closely combined with the development of legal aid at the grass-roots level so as to promote the development of legal aid with the continuous improvement of the public legal service system.It is emphasized that scientific and technological progress should be closely combined with the development of legal aid at the grass-roots level.It is necessary to promote the development of legal aid with scientific and technological progress,explore and establish an information-based case quality supervision system,and strengthen the case quality supervision by means of information technology so as to better realize the function and value of legal aid.The study of legal aid system at the grass-roots level can theoretically provide reference for the reform of judicial system,especially for the reform of legal aid.In practice,it is conducive to safeguarding the legitimate rights of vulnerable groups,promoting judicial justice and maintaining social harmony and stability.
