Reseach On The Legal Issues Of University Campus Construction Under PPP Mode

With the continuous popularization of higher education in China,the number of people being educated is increasing year by year.Under the situation that the four sources of university funds,namely government financial appropriation,tuition and miscellaneous fees paid by students,income from university's own production,study and research,and social donation,cannot meet the capital needs of university campus construction,universities adopt "school-bank cooperation" one after another to exchange construction funds at the cost of high interest.As a result,the financial pressure on universities rose and high loans became unpayable.In recent years,the state council and the ministry of finance,the national development and reform commission and other government departments in public infrastructure construction vigorously promote government and social capital cooperation model(PPP model),the model not only can make the free university of bank loans of the huge pressure,can also bring in social capital operation of campus quality service,has brought the new vitality for university campus construction fields.From the perspective of the development of PPP mode applied in the construction of university campus in China,the application of PPP mode in the field of university campus construction is still in the initial stage from the perspective of internal environment.Look from the external environment of the PPP project system countries have not yet law norms,scattered related operations in the administrative rules and local regulations,rules and regulations are different department conflict,the PPP project system security system is not perfect,individual power without supervision of default on business in the operation of the PPP projects,resulting in 2018 by the state,unable to get legal protection projects' rights and interests project dispute processing difficulties and other issues.Therefore,in order to ensure the smooth operation of the PPP model in the field of university campus construction,should face up to now the PPP mode in university campus construction practice,the main legal problems through using the PPP mode in domestic and foreign successful experience in law in the construction of university campus,to absorb and then combined with the actual situation in our country put forward targeted legal measures,make the university campus construction smoothly to the ground.This paper starts with the overview of university campus construction under the PPP mode.Firstly,it studies the concept discrimination and theoretical basis,and analyzes the feasibility and necessity of applying PPP mode in the field of university campus construction.Secondly,the paper expounds the practical and legislative status of the construction of university campus under the PPP mode,and then summarizes the key legal issues such as laws and regulations,project contracts,and project subjects in the construction of university campus under the initial PPP mode.Finally,by summarizing the successful practical experience of applying PPP model to the construction of university campuses in other countries,this paper puts forward the legal countermeasures of applying PPP model to the construction of university campuses in China,so as to explore a good legal environment for the introduction of PPP model in the construction of university campuses in China.
