Study On The Legal Thought Of Su Shi

Su Shi was a famous literary master in the Northern Song Dynasty and a politician who believed in the rule of law.These preserved works not only show the world Su Shi's extremely high literary attainments and political ideals,but also have a lot of space to discuss Su Shi's unique views on law.In Su Shi's legal thoughts,his understanding and discussion of the relationship between the state,the people and the society are of great contemporary significance.Su Shi adheres to the social governance view of "combining morality with law".and believes that the cultivation of morality on the public is the key to a good social order.At the same time,he advocated "the law is simple",against the detailed provisions.In the aspect of crime and punishment,Su Shi advocated the view of "punishing suspicion from the beginning" and deliberating punishment.Su Shi also has a keen sense of national security.He believes that illegal trade should be strictly prohibited and smuggling should be severely cracked down on.In terms of the litigation system,Su Shi put forward the idea of "if you complain,you must see".He believed that people's complaints should be paid attention to and solved.Therefore,he advocated the people-oriented thought of appointing people on their merits and improving the administration of state affairs.This paper mainly through the collection of ancient documents and the analysis of ancient scholars on sushi,to sushi existing anthology as the main research object,combined with the background of The Times,further demonstrate sushi's legal thoughts.Combined with the current situation of China's legal system,many of Su Shi's forward-looking legal thoughts and modern legal system dialogue.The innovation of this paper lies in that the previous articles focus on the research of what Su Shi's legal thoughts are and how they are embodied,but there is no special study of the advanced nature embodied in this ideological system.It is also embodied in his legal thoughts in various forms,in the legislation and judicature as well as in various branches of law,and has a great reference to the sound of modern legal system.
