Title Of Study On The Combination Of The Rule Of Virtue And The Rule Of Law In The New Era

Rule of virtue and rule of law,as an important way of national governance,have always been an important topic to be discussed and studied.Through the analysis of the thoughts of "rule of virtue" and "rule of law" in ancient China and the west,we can find that with the change of social background,there are great differences in the theoretical circles' attitudes towards the "rule of virtue" and "rule of law" as well as the strategies adopted by the state.The civilization of rule of law in western society and the combination of rule of rite and the rule of law in ancient Chinese are related to their own national conditions and characteristics of the times.Under the influence of The Times,the rule of virtue and the rule of law,as part of the superstructure,have different connotations and characteristics in different historical development stages.The rule of virtue and rule of law of socialism with Chinese characteristics in the new era are fundamentally different from the rule of virtue and rule of law in ancient China and the rule of law and rule of law in western capitalism in terms of theoretical basis,practical basis and class essence.The rule of virtue and the rule of law in socialism with Chinese characteristics are guided by Marxism,based on the thought of socialism with Chinese characteristics in the new era,and with the core socialist values as the main thrust.Finally,under the guidance of the background of socialism with Chinese characteristics in the new era,the combination of the two is realized.By summing up the rule of governance in ancient and modern China and foreign countries and analyzing the advantages and disadvantages of morality and law,we can find that both rule of virtue and rule of law are not omnipotent,and both have their own advantages and disadvantages.Both morality and law have their own advantages and disadvantages in the means,scope and status of national governance.Only by combining them,can they make up for their own shortcomings to achieve complementary,mutually reinforcing effect,can better play their functions,and thus achieve the comprehensive governance of the country.In the process of combining morality with law,rule by virtue and rule by law,we should not only reasonably analyze the coincidence of the combination of the two,but also grasp the "degree" of the combination of the two,so we should not confuse morality with the law.On the one hand,we should combine morality and law on th e premise of their independence,on the other hand,we should clarify the boundary of moral legalization,so as to avoid the tendency of "pan-moralization" and "omnipotent of law".The combination of rule of virtue and rule of law in the new era is not only of theoretical significance,but also of very important practical value.The combination of rule of virtue and rule of law is not only the realistic requirement to solve the principal contradictions of the society in the new era,but also the inherent requirement of taking the road of ruling by law by socialism with Chinese characteristics,or the inevitable requirement of building a socialist market economy.It is also an important guarantee to realize the modernization of national governance.This complex and systematic project requires the combination of theory and practice,as well as the coordinated efforts of the state,society and individuals.First of all,we should adhere to the Party's leadership in the combination of moral and rule of law.Secondly,we should create a social atmosphere in which rule of morality and rule of law are combined.Third,we should build a culture of rule of law in which morality and law are unified.And finally,we should cultivate the quality of rule of law and moral quality of the whole nation.Only in this way can we realize the strategy of"rule by virtue and law"of socialism with Chinese characteristics in the new era,and realize the great rejuvenation of the Chinese nation.
