Study On Governing The Country Based On The Combination Of Rule Of Law And Rule Of Morals

To improve and develop the socialist system with Chinese characteristics, promoting the modernization of national governance system and governance capacity has been identified as the overall goal of deepening reform in 18 Third Plenary Session. From the perspective of national governance, the rule of law and the rule of morals have different positions and functions. The rule of law belongs to political construction and political civilization, which is an important support of national governance system and ability. The rule of morals belongs to ideological construction and spiritual civilization. In the process of governing modernization development, the rule of law is the basic strategy of governing a country, while the rule of morals plays an irreplaceable rule for the rule of law. The two features mentioned above must be combined and integral. Only stick to the principle that the rule of law and the rule of morals should be combined could better contribute to the country governing. The power of the law is caused by the support and sincere believes of the people.In this dissertation, the main research method is a combination of literature analysis, comparative analysis and cross-subject method. Firstly analyzing the excellent literatures home and abroad with the reference to relevant literatures builds the dissertation theoretical basis shown in the thesis that the governing idea is the combination of the rule of law and the rule of morals. Secondly from the macroscopic angle this dissertation makes a historical explanation about rule of law and rule of morals through the comparative analysis of the past, the present and the future of rule of law and rule of morals. Meanwhile, through vertical comparison between the ideas of several generations of the Chinese Communist Party leaders, the specific development of the rule of law and the rule of morals have been concluded in different periods. In the end, the dissertation applies to cross-subject method that uses relevant theories of politics, philosophy, law and management to do further study.This thesis is divided into six parts:the first part tells the background and meaning of this thesis, collating research result from both domestic and foreign country, and stating the thesis construction, research method and point out advantages and disadvantages about this thesis; The second part definite the concept of rule of law and rule of morals, and stating idea about managing together law with morals in ancient China and idea about rule of law and rule of morals that raised by Marx and Engels; The third part through the exploration of the legal system in the early days of the founding of the PRC, statement the three generation of Deng Xiaoping, Jiang Zemin, Hu Jintao thought of rule of law and the summary of the development of rule of law from The 18 National Congress of CPC, elaborates systematically combination of rule of law and rule of virtue is scientific summary of governing country; The forth part from relationship between rule of law and rule of morals to state during the period of realizing national governance modernization, the important effect and meaning of rule of law and rule of morals; The fifth part by adhering to nourish the spirit of the rule of law, strengthen the supporting role of ethics to the rule of law culture and adhering to the rule of law embodies the concept of a moral, strengthening the legal construction of morals promoting role in two aspects of the rule of law and ethics combined specific path of thinking and exploring.
