System Of A List Of Government Power Under The Marxist Power Restriction Sight

"All power belongs to the people" is not only the political idea that our party has always followed,but also the highest norm and constitutional principle of the rule of law in our country.However,such ideas and guidelines must rely on the specific power behavior of all levels of the organs and authorities to achieve.In the process of reform and opening up,the blurring of the administrative terms of reference of all levels of government and their working departments in China has led to the widespread phenomenon of "compete for power" and "abstention" between the administrative departments,the rampant power of power to rent,rent-seeking,and the serious intersection of administrative functions,and the pushback and rip-off of administrative organs have seriously affected It also affects the realization of the legitimate rights and interests of administrative counterpart.It is against this background that under the guidance of Xi Jinping’s socialist thought of Chinese characteristics,the system of local government power list comes into being.The system of local government power list is a kind of government administrative authority operation management system implemented by the CPC Central Committee and the State Council in the new era of socialist construction with Chinese characteristics.Its core content is that by combing and cleaning up the functions and responsibilities of the various departments of local government,the list of terms of reference of each work department is formed in the form of a catalogue,and the list of responsibilities corresponding to the authority is published and made publicly available to the society.In the list of terms of reference,we should clarify the type,basis,exercise subject,exercise process and supervision mode of the authority.In the list of responsibilities,we should clarify the subject of responsibility and the form of responsibility,and improve the accountability mechanism.Since March 2015,when the state-run issued the "Guidance on the implementation of the Power list system of local government departments at all levels",in less than five years,up to the departments of the State Council,down to provincial,municipal and countygovernments and their constituent departments,most of them have published their own list of powers,and the list of responsibilities is also being published.Some township governments and village councils have also published their own lists of powers.Thus,the start of the Power list system is rapid,but the function of the system,especially the power list system of the power restriction mechanism of the formation and effectiveness of the play is not overnight.Based on the Marxist view of power restriction,especially taking Xi Jinping’s view of power restriction in the socialist thought of Chinese characteristics in the new era as a theoretical tool,this paper studies the Power List system in the dimension of power restriction.The contents of this article include the following sections:Firstly,the author Combs The concept and thought of power restriction and supervision from the classical writers since Marx and Engels,and studies the exposition of power restriction by the leaders of our party since Mao Zedong,especially the theory of the restriction of socialist power in Xi Jinping’s new era with Chinese characteristics.Secondly,it studies the formation process and basic theory of the Government Power list system in our country,and clarifies the concept,nature,orientation and effectiveness presupposition of the Power list system in theory.Thirdly,this paper studies the present situation and problems of the power restriction mechanism of the Government power list system,and through the practical consideration of the system,analyzes and summarizes the problems and difficulties of the government power list system in the formation of the power restriction mechanism.Finally,on the premise of clarifying the problems and difficulties,this paper puts forward some suggestions on the perfection of the power restriction mechanism of the power list.
