An Empirical Study On Legal Issues Of Community Drug Rehabilitation In China

The Anti-Drug Law of the People's Republic of China promulgated on June 1,2008 and the Drug Rehabilitation Regulations promulgated on June 22,2011 jointly constructed China's complete drug rehabilitation system.In the framework of the entire drug rehabilitation system,the "Anti-Drug Law of the People's Republic of China" clarifies the basic status of community drug rehabilitation.Community drug rehabilitation and community rehabilitation are indispensable important links in the process of drug rehabilitation.However,the rehabilitation of community drug rehabilitation community is a long-term and arduous system project.It requires the participation of many parties in the society,and the joint efforts to promote the rehabilitation work of community drug rehabilitation communities can better enable drug users to return to themselves,return to their families,and return society.Based on this,the author inspected the community drug rehabilitation work of the Z community in Q city of Y province,understood the basic situation of drug rehabilitation work in Z community,and discussed the existence of the community drug rehabilitation system in the legal regulations,implementation process and supervision.The problem is to improve the community rehabilitation system in China.The full text is divided into five parts.The first part introduces the concept of community rehabilitation and rehabilitation,including the concept of community,the concept of community detoxification and the concept of community rehabilitation.Secondly,it introduces the legal provisions of community rehabilitation and rehabilitation,paving the way for the detailed discussion below.The second part,taking Z community in Q city of Y province as a sample,first introduces the poison situation of Q city in Y province,then introduces the current situation of drug users in Z community of Q city of Y province,and finally introduces the detoxification of Z community in Q city of Y province.The basic situation of rehabilitation work.The third part,based on the investigation of Z community in Q city of Y province,finds the problems in the legal system of community drug rehabilitation in China.First of all,in the community drug abuse laws and regulations in China,the application of community drug rehabilitation is not targeted,the application period of community drug rehabilitation is too rigid,the identification subject of drug addiction is present,and the connection between compulsory isolation drug rehabilitation and community rehabilitation is vague;secondly,In the implementation of the legal system of community drug rehabilitation in China,the lack of community drug rehabilitation professionals,the difficulty in controlling and controlling community drug rehabilitation personnel,the lack of psychological treatment for community drug rehabilitation workers and the legal rights of community drug rehabilitation personnel are difficult to protect;finally,the implementation of community drug rehabilitation in China In the supervision,the assessment mechanism is insufficient,the follow-up mechanism is slow,and the necessary accountability mechanism is lacking.In the fourth part,the author tries to explore and improve the suggestions on the legal system of community drug rehabilitation in China.First of all,in the provisions of the community drug abuse laws in China,the author proposes to scientifically define the applicable objects of community drug rehabilitation,design the flexible application period of drug addiction in the community,improve the provisions of the subject of drug addiction recognition,and clarify the connection rules between compulsory isolation and drug rehabilitation and community rehabilitation;In the implementation of community drug rehabilitation system in our country,the author proposes to strengthen the professional construction of community drug rehabilitation teams,implement grid management and control of community drug rehabilitation personnel,focus on psychological counseling for community drug rehabilitation personnel,and implement social security system for community drug rehabilitation personnel;In the supervision of the implementation of community drug rehabilitation in China,the author proposes to improve the performance appraisal,reward and punishment mechanism,follow-up assessment mechanism and necessary supervision mechanism.The fifth part summarizes the full text and fully affirms the important status of the community drug rehabilitation legal system.At the same time,it finds the problems in the actual implementation of the community drug rehabilitation legal system and proposes to improve the legal system of community drug rehabilitation in China.
