With the gradual advance of supply-side structural reform,China’s economic development has entered a new normal.Labor relations are also undergoing profound changes,especially the current economic downturn and the complexity and intensity of labor and capital contradictions to China’s current labor dispute handling mechanism challenges.The labor relation is an essential link in the social relation.Therefore,to improve the labor relations,strengthen the management of labor relations,resolve the contradictions between labor and capital,and minimize the harm of labor disputes,is the government in the new situation of labor relations and labor disputes must be solved,and is also the academic research topic.From the perspective of harmonious society,this paper puts forward the research hypothesis based on the theory of labor conflict,Sandver theory model,risk management theory and harmonious society theory.Through interviews and questionnaires,relevant data were obtained.Factor analysis method was used to reduce the dimension,and then regression analysis method was used to determine the six factors influencing the labor dispute prevention mechanism in Xingtai city.Finally,the conclusion is drawn and some Suggestions are put forward for the establishment of labor dispute prevention mechanism.It is found that workers can effectively safeguard their own legal rights and interests by improving their awareness of law and democracy.The establishment of reasonable rules and regulations and democratic management system and the strengthening of labor contract management can effectively resolve labor disputes.In view of the fact that laborers prefer to choose "non-institutionalized approach" to solve labor disputes,especially the characteristic of choosing to negotiate with enterprises on their own,the labor dispute committee of enterprises becomes an important channel for laborers to provide their rights and interests.As the spokesman and maintainer of the workers,the role of the trade union in the prevention mechanism of labor dispute is irreplaceable,especially in the two aspects of consultation and mediation.Government labor department and supervision department in the formulation,publicity and supervision of legal policies to improve the legal awareness of workers and enterprises,to supervise the legal employment of enterprises,to promote the establishment and improvement of labor dispute prevention mechanism,for the stability and harmony of labor relations to provide a basic guarantee.The construction of labor dispute prevention mechanism can take the following measures from the four aspects of labor,enterprises,trade unions and the government: First,to enhance the legal consciousness and democratic consciousness of the workers.We should encourage workers to take the initiative to learn legal knowledge,actively participate in the building of the democratic system in enterprises,and enhance their ability to protect themselves and prevent others from doing so.Second,the enterprise should establish reasonable rules and regulations and democratic management system,strengthen the enterprise labor contract management,from the source to reduce the incidence of labor disputes;Third,we should encourage trade unions to participate in the prevention and settlement of labor disputes in the whole process,give play to their important role in consultation and mediation,and provide a platform for equal consultation between labor and capital,so as to prevent the occurrence of conflicts in advance or to make both sides reconcile through dialogue,so as to protect the legitimate rights and interests of workers.Fourth,we should improve the formulation of policies and laws,enhance the legal awareness of labor and capital through intensified publicity and consultation,and thoroughly implement the concept of labor dispute prevention to enterprises and workers.At the same time,we should strengthen the inspection of enterprises’ compliance with labor laws,and resolutely investigate and punish all kinds of illegal and disciplinary behaviors,so as to maintain labor order and build harmonious labor relations...
