The Study On The Legal Issues Of Cyber Security Supervision In Public Security Organs

Network security is an important issue facing the whole world.With the rapid development of information technology,network not only connects every corner of the world,but also threatens international peace and security.Countries have raised higher requirements for cyber security supervision,introduced various systems and laws to ensure cyber information security,and strengthened prevention,control and early warning of cyber security.As the maintainer and law enforcer of network security supervision,the public security organ has an inescapable responsibility in the guidance and response of network security crisis.China's network security legislation after the computer information system legislation,Internet security and content security legislation,information security strategy and other stages,"network security law" was officially promulgated in 2017,together with other network security related laws,to provide legal basis for China's network security supervision.Public security organs,as an important responsibility subject clearly defined in the network security law,should earnestly fulfill the responsibilities entrusted by the network security law,and take into account the two aspects of public security information network security protection and public information network security supervision,so as to escort China's network security.However,at present,China's public security organs still have many legal problems in the network security supervision,affecting the implementation of the network security supervision function of the public security organs,the application of public security network security supervision law research,is an important issue that needs to be solved.This paper is divided into five parts.The first part mainly introduces the background and significance of the study on the application of law of public security network security supervision,and sorts out the legislation of network security supervision at home and abroad,laying a theoretical foundation for the study of this paper.The second part of the public security organ network safety regulation applicable law has carried on the detailed analysis of carding public security network security supervision legal system,and from the perspective of the network safety "clear responsibility,public security organs of the public security organ regulatory content and build a network security network security protection system is analyzed,and resolved the network safety highlighted in the applicable law of the public security organs of the regulatory body.The third part analyzes the legal problems of supervision practice,the public security network from two aspects of the public security organs to maintain safe operation of network information security and public security organs of the current network security is expounded the present situation of the supervision work,find out the main existing problems,and network security regulatory laws and regulations lag,lack of the network security supervision main body the legal responsibility,lack of jurisdiction is difficult to define,integrated control network link.The fourth part of the public security organs to strengthen the legal protection of network security supervision put forward countermeasures and Suggestions,from the public security organs network security supervision legal system construction,standardize the legal responsibility of network security supervision subject and administrative law enforcement procedures,strengthen the cooperation mechanism of network security supervision in four aspects put forward perfect Suggestions.
