Study On The Problems,Reasons And Countermeasures Of The Construction Of Grass-roots Wisdom Courts

Since the eighteen Party Congress,general secretary Xi Jinping emphasized the importance of information work in his speeches many times,and pointed out that "without information,there will be no modernization." President Zhou Qiang of the Supreme People' s Court pointed out at the fifth session of the National People' s Congress in 2017 that as a profound change of the people' s court,judicial reform and information construction have become "two rounds of vehicles and two wings of birds" for the development of the work of the people's court.The premise of the construction of "wisdom court" is the informatization of the court.On the basis of vigorously developing the informatization of the court,the Supreme People' s court proposed to build a "wisdom court"in an all-round way in 2016,formally introducing the concept of "wisdom court" into the vision of the fourth level courts in China.As the 2018 evaluation report shows that the national "wisdom court" has taken shape initially,and has begun to enter the era of building "wisdom court 3.0".How to make the construction of wisdom court play a greater role in improving judicial efficiency and promoting judicial justice is a problem that every "wisdom court" builder has been thinking about.Based on the theory of grassroots bureaucrats and system management,this paper analyzes the construction of grassroots wisdom court by using case study,field investigation and other research methods,on the basis of judicial reform and wisdom court construction,and from three aspects of information island,performance orientation and resource endowment.Taking the L District Court of Shandong Province as an example,this paper analyzes the intelligence of the court in depth Based on the detailed analysis of the current situation of the system,i.e.based on the full business online processing,full process node management and control,all-round intelligent service,and full time and space operation and maintenance guarantee,this paper demonstrates the status of the construction of the wisdom court in Shandong Province in recent years and analyzes the overall construction situation of Shandong Province,and then comes to the problems in the construction of the wisdom court This paper analyzes the causes of these problems in detail,that is,the lack of top-level design,the neglect of users,and the lack of human and property security in the construction of the wisdom court system.Combined with the construction requirements put forward by the Supreme People' s court,based on the "three services" and the "four in one" concept of promoting the construction of the wisdom court of "wisdom trial,wisdom execution,wisdom management,and wisdom service",it restructures the process of trial execution,and strengthens the system from removing the information island Unified management,establishment of correct performance orientation,construction of in-depth application system based on demand,enhancement of human and property security,optimization of court management and management are three major aspects to put forward constructive plans and countermeasures,introduce the most cutting-edge ideas and technologies of court informatization development such as"judicial chain",boost judicial reform with the help of modern information technology,and promote the modernization of national governance system and governance capacity.
