Research On Administrative Law En Forcement Protection Of The Legitim Ate Rights And Interests Of Migrant Workers In Construction Industry

As one of the main force of labor-intensive industries in China,the construction industry migrant workers play an irreplaceable role in China's urban modernization.Due to the particularity of their work and the insufficiency of law enforcement by relevant administrative organs,migrant workers in the construction industry frequently suffer from the infringement of their legitimate rights and interests by construction enterprises or contractors in practice,such as the infringement of the right to personal safety,wage arrears,the right to rest,and the difficulty in compensation for industrial injuries.The legal rights and interests of migrant workers in the construction industry have been infringed in many aspects due to the lack of law enforcement by relevant administrative law enforcement agencies,which is specifically reflected in the lack of law enforcement supervision over the safety of production,production and living environment,wage arrears,non-signing of labor contracts and other issues in the construction industry.The author studies the legal rights and interests of migrant workers in construction industry from the perspective of administrative law enforcement,aiming at standardizing the law enforcement activities of relevant administrative law enforcement agencies and safeguarding the legal rights and interests of migrant workers in construction industry.This paper focuses on the analysis and research of the right to personal safety,economic rights and interests,cultural and educational rights and social security rights of migrant workers in the construction industry,and concludes that the legitimate rights and interests of migrant workers in the construction industry mainly include the right to labor,the right to claim for wages,the right to rest,the right to equal employment,the right to claim for compensation for industrial injuries and other rights and interests.Analysing and analyzing from the Angle of administrative law enforcement,safety,environmental protection departments,emergency management,market supervision and management departments,the Labour administrative supervisory departments,cultural education department,the department of housing and urban-rural construction,labor and social security departments and other relevant administrative law enforcement inthe protection of the construction problems of peasant workers' legitimate rights and interests,main show is inaction of administrative law enforcement,law enforcement is not strong,the absence of law enforcement and supervision,takes office in accordance with the law does not reach the designated position,etc.In-depth analysis of the important reasons for the lack of administrative law enforcement protection of the legitimate rights and interests of migrant workers in the construction industry,mainly from the legislative,administrative law enforcement supervision mechanism,the rule of law cultural environment three aspects of argumentation and research,draw the conclusion that the legislation is not sound,lack of targeted law enforcement,administrative law enforcement environment is poor.Finally,this paper puts forward feasible Suggestions and countermeasures from the following three aspects: perfecting legislation,consolidating and standardizing administrative law enforcement,and striving to build a scientific and powerful cultural environment of law enforcement and rule of law.
