Optimizing The Role Of The CCP Committee In The Governance Of State-owned Enterprises

In order to fulfill the objectives of the 18th National Congress,China has strengthened the investigation and punishment against corruption,and a group of people have been punished for corruption after the 18th National Congress.Among them,many are senior executives of state-owned enterprises.For state-owned enterprises,how to improve the operational efficiency of the enterprises and reduce the incidence of corruption has become their most urgent and important issue.The corruption in state-owned enterprises relates to,to some extent,the failure of the enterprise's CPC committee to fully perform their functions and duties.As the supervision system is under a reform,the CPC committee of state-owned enterprises need to figure out how to participate in the enterprise governance in a normative and efficient manner under the premise of satisfactory corruption control and adequate efficiency.Based on the above thoughts,this paper combines theories and practices to observe and analyze the improper governance of the CPC committee of state-owned enterprises,and find that the CPC committee of state-owned enterprises are special organizations that act as the core leader in the enterprises.However,the current law fails to provide a clear definition of the legal status and functions of the CPC committee of state-owned enterprises,which in practice confuses the CPC committee of state-owned enterprises when they try to perform their functions and duties and leads to their failure of governance or their omission.Therefore,as the Supervision Law of the PRC has been promulgated,the CPC committee of state-owned enterprises should shift their thoughts and strengthen their supervision.Moreover,the amendment to the Company Law of the PRC should clarify the CPC committee's legal status,establishment,statutory power,enforcement procedures,managerial authority beside the board of directors,and the boundary of power between them and the board of supervisors.At the same time,the supervisory committee should also strengthen its supervision over the decision-making activities of the CPC committee of state-owned enterprises,thereby enhancing the ability and efficiency of the governance of the CPC committee of state-owned enterprises.
