Teachers' right of punishment is a hot topic that has attracted much attention in recent years.Disciplinary power is the responsibility and power of teachers.Disciplinary education should be an indispensable means in the process of teacher education,but it has a name in middle school education.There are two extreme cases,one is that teachers do not use or abuse punishment methods,and the other is abuse or excessive use,which cannot accurately grasp the limits of punishment and use excessively.The main reason for these situations is that laws and regulations do not have clear and specific provisions on punishment,and the concept and quality of teachers who implement punishment rights need to be further improved.In the end,teachers are at a loss as to how to implement,what are the limits of implementation,who has the qualifications to enforce disciplinary powers,and the degree of implementation.Based on the analysis of the actual situation,this paper is devoted to researching the teacher's punishment right from the theory of law,further enriching the legal basis of the teacher's punishment right,demonstrating the necessity of its existence from the perspective of jurisprudence,and demonstrating the teacher's punishment right Barrier-free implementation constructs a comprehensive design idea based on law and the construction of a system.It is hoped that it can contribute to accelerating the implementation of teachers'punishment rights and promote the development of education in ChinaIn the introduction,the teacher punishment issues are explained from the background,purpose,status,significance,method,and innovation.The second part is an introduction to the basic theory of teachers' right to punish.First of all,the connotation of teachers' punishment power is clarified,and the concept of punishment has a clear and clear grasp.Secondly,it focuses on the legal basis of teacher's right of punishment,from the rationality and legitimacy of the right of education to punishment,the unity and consistency of teachers' responsibilities and powers,the maintenance and guarantee of students' rights,the enlightenment and standardization of teachers' right of punishment.This paper discusses the balance,adaptability of teachers' right to punish,and the prescriptive and demanding requirements of teacher education laws.Forensic analysis is made on the principles of teachers' right to punish,the objects to be implemented,and the scope of punishment.On the whole,there is a general understanding of teachers' right to punish.The third part analyzes the predicament of the teacher's punishment and the reasons for it.The factual dilemma of teachers' right of punishment is mainly due to the fact that teachers cannot accurately use the right of punishment,and the law that clearly implements the detailed rules for punishment lags behind the reality,and the school's provision of relief methods is lacking.The main reasons for these dilemmas are the over-generalization of the law on the punishment of teachers,the lack of effective supervision mechanisms in the implementation process,the unsuccessful channels for appeals after implementation,and the need for further improvement of teachers' individual legal literacy.The fourth part is an effective way to implement teachers' punishment right.From the perspective of law makers,law enforcers,legal supervisors,and defenders of the law,suggestions are given,and their own thoughts are put forward on the path of teachers'punishment rights.
