The Study Of The Legal System Of High-Tech Achievement Transformation In Chinese Colleges

Knowledge-based economy has become mainstream today,with the rapid development of science and technology which like splitting a bamboo.At present,scientific and technological achievements into the legal system of university in China have been formed,which is based on the spirit of the Constitution.The Science and Technology Progress Law and Law on Promoting the Transformation of Scientific and Technological Achievements is the foundation,while regulations,rules,policies of the Ministry of Science and Technology,the Ministry of Education play a supporting role.However,scientific and technological achievements of universities remain low conversion rate.If the situation is not reasonably resolved,it will seriously hinder the development of scientific and technological innovation in Chinese universities.The reason is the legal issues in the transformation of university scientific achievements.The specific issues are as follows:the ownership system of scientific and technological achievements in colleges and universities needs to be optimized;the income distribution reward system is not perfect;the value evaluation mechanism is unsound;the risk investment mechanism is to be improved;and the dispute mechanism is imperfect.It's visible that the laws of transformation of science and technology achievements in colleges can't adapt the need of the colleges.There are four parts in this paper.The first part is outline of the high-tech achievement transformation in colleges.First of all,it explained the concepts of high-tech achievement transformation,such as high-tech achievements,achievement transformation,and related legal systems.Then analysis of the relevant legal relationship on high-tech achievement transformation is putout,including the relationship between universities and researchers,enterprises and the country.Secondly,it's the question that legislation,pattern and problems on the high-tech achievement transformation in colleges.The first one discuss the legislative status of high-tech achievement transformation from the perspective of national legislation and local legislation.The second part analyze four types of patterns in high-tech achievements of Chinese colleges.The last one discuss the legal issues in the transformation of high-tech achievements.The third chapter is the relevant legislation and practical experience of foreign universities' high-tech achievement transformation.It mainly analyzes the legislation of the high-tech achievement transformation in developed countries such as the USA,Japan and Germany,and summarizes the experience of foreign universities in the high-tech achievement transformation.substantive transformation institutions,a reasonable and effective reward and incentive system,and an emphasis on industry-university-research cooperation and personnel training are the reason of the successful.The last is the improvement of the legal system for the high-tech achievement transformation in colleges.I make recommendations from six aspects:improve the legislation of the high-tech achievement transformation in colleges,clarify the incentive mechanism for the high-tech achievement transformation in colleges,implement the evaluation mechanism for the high-tech achievement transformation in colleges,improve the risk investment mechanism for the high-tech achievement transformation in colleges,establish institutions for the high-tech achievement transformation in colleges,and robust dispute resolution mechanism.The main point of this article is to learn the advance experience of developed countries on the high-tech achievement transformation,combined with the problems of the high-tech achievement transformation in Chinese colleges,and recommendations from the source of legislation should be propose to improve the high-tech achievement transformation in colleges.In this way,the low conversion rate of the high-tech achievement transformation in colleges can be changed,and it is helpful to promote the high-tech achievement transformation in colleges,promote economic growth and build an innovative country.
