A Theory On The Nature And Scope And Jurisdiction Of Network Sovereignty

In today's Internet age,the network plays an important role,and closely linked to people's production and life,once the damage will lead to the stability of social order and national security.Network has become the besides land,sea,air,the day of the fifth big sovereign space,is a natural extension,in the field of national sovereignty in the network has become an important part of national sovereignty.But because the network has technical,transnational,openness and anonymity of the characteristic,has compared with the traditional national sovereignty,adds more complexity.Due to network with global characteristics,make the boundary of the network sovereignty is difficult to determine,the boundary is difficult to determine,so as to cause problems of jurisdiction,to how to maintain a country's sovereignty,network become an important research subject.This paper will be divided into four chapters to discuss the network sovereignty,the first part is mainly to know national sovereignty theory,because national sovereignty is the foundation of the research network sovereignty,which reveals the nature of the network sovereignty,know clearly the nature of the network sovereignty to better provide direction for maintenance of network sovereignty.The second part is to discuss the range of network sovereignty,namely the network definition of the boundary of the sovereign.Due to network sovereignty has the characteristics such as global,sharing,make the boundary of the network sovereignty cannot be as clear as the boundary of the traditional national sovereignty,the border of network sovereignty to the key point of how to determine became to be discussed.The third part is to discuss network administration problem of sovereignty.Due to network sharing characteristics,and national laws and regulations are not the same,easy to produce conflict,should adopt what kind of principle coordinate conflict is the solution to network sovereignty.The fourth part discuss how to maintain the network security of our country.Mainly summarized from the network legislation in our country at present the legislation situation about network sovereignty,network legal system to put forward the corresponding measures,so as to maintain the network security of the country.
