Study On The Filing And Review System Of Normative Documents Under Xi Jinping’s Governing The Country By Constitution

There is a relationship between the filing and review system of normative documents in China and Xi Jinping’s idea of running the country according to the constitution.On the one hand,Xi Jinping’s rule of law requires that all laws and a large number of normative documents with the nature of "quasi-law" should conform to the constitution and not violate the purpose and spirit of the constitution.On the other hand,the development and improvement of the filing and review system of normative documents is also the concrete manifestation of the "implementation" of the concept of governance based on the constitution.China’s normative document preparation and review system is a legislative supervision system in China,which plays an extraordinary role in maintaining the unity of the legal system and protecting the legitimate rights and interests of citizens,so the role of the filing and review system is extremely important.However,in practice,there are still some problems in the system,such as too narrow scope,unclear standards and imperfect external supervision mechanism,which need to be solved urgently.In view of these problems,this paper puts forward the idea of improving the system of preparation and review of normative documents in China.The scope of filing shall be determined according to the content rather than form of normative documents,and the normative documents jointly issued by the party and government and published by local "two houses" shall be included in the scope of filing.The examination standards are clearly refined to realize the restriction of public power and the protection of private rights.The relationship between individual interests and public interests is adjusted to make the public satisfied.We will increase public participation and publicity,introduce new ways of participation,expand channels,provide comment platforms,and obtain the most authentic public opinions.Set up a special review organization and full-time personnel,organize training and learning,constantly improve the ability of the staff,and actively carry out cooperation and exchanges with the field,communication experience;Starting with the enacting agency and the examining agency,the relevant responsible personnel shall be held accountable and accountable according to the harm caused by the intentional or gross negligence of the staff;Make use of modern Internet platform and big data analysis,build a new mode of Internet plus censorship,the cloud platform reviews the normative documents,and reviews their legitimacy,and then the relevant staff and the people in the jurisdiction judge its rationality,Support the supervision of normative documents through technical support.
