Research On The System Of Normative Document Filing And Examination

As an important part of China's current supervisory system,the regulatory review system for normative documents is playing an important role in safeguarding the unity of the legal system and protecting citizens' rights and interests.The record review system can not only keep the upper and lower laws consistent,and ensure that the normative documents do not conflict with the Constitution;at the same time,it can also maintain the unity of the national legal system and urge the legislative bodies to legislate according to law.Sexual system design.However,in combination with the actual situation,the incompleteness of China's normative document filing review system itself and the constraints in the filing review work have a relatively negative impact on the progress of China's rule of law construction.Overall,the development situation facing the filing and review work is still grim.At the same time,the combination of the theory and practice of the record review system is insufficient,and the theoretical provisions cannot be specifically implemented in practice.Therefore,in order to promote the more complete development of the regulatory review system,it is of great significance to study it and explore new ideas for the development of the system.This article is divided into four parts to study the regulatory review system of normative documents.The first part starts with the meaning of the regulatory review system for filing documents,and on the basis of analyzing the relevant legal concepts in the regulatory review system for filing documents,the significance and theoretical basis of the system establishment are clarified.Then in the second part,by collecting relevant information,it summarizes the origin and development of China's normative document record review system.At the same time,it compares the foreign normative document filing review system with China,and summarizes the extra-territorial experience on the basis of exploring common points and differences.Guided by the idea of gradually establishing a society ruled by law and a government ruled by law,China has made tremendous progress in the establishment of a system for reviewing and filing normative documents.However,due to the complexity of China's national conditions,the current record review system itself is flawed.Therefore,a relatively unified and clear standard basis has not yet been established in China to regulate the record review system for regulatory documents.The third part of this article combines the actual situation,analyzes the current situation of China's regulatory filing record review system,and explores the main causes of defects in the record review system.Finally,in the fourth part,in view of the problems existing in the record review system,it is proposed to propose basic ideas for the system construction in terms of the construction of the legal regulations system,the coordination of the record review system and other relief systems,and strengthening social supervision.The author intends to investigate the status of China's normative document filing review system through investigation and reviewing the relevant data of the normative document filing review system,through a comparative study of the filing review situation in different regions of the country and abroad,and using the method of usage interpretation Explain and analyze the shortcomings and deficiencies of the system.It is hoped that based on this,I would like to put forward my own opinion on better perfecting the system of filing and review of regulatory documents.
