In recent years,centering on the purpose of "improving the quality of legislation",the Party Central Committee with General Secretary Xi Jinping as the core has always attached great importance to the construction of the rule of law and legislative work,and has proposed a series of new ideas and new measures for the construction of the rule of law,especially legislative work,New requirements.The Fourth Plenary Session of the Eighteenth Central Committee of the Party explicitly requested the establishment of a third-party evaluation mechanism.On December 28,2017,the General Office of the Standing Committee of the National People 's Congress issued the “Working Standards on the Argumentation and Consultation on Major Interest Adjustments Involved in Legislation” and “Working Standards on the Introduction of Third-Party Evaluation of Important Legislative Matters Concerning Major Issues” The issuance of the two documents marks that when major interest adjustment problems encountered in legislation and important controversial and important legislative matters are encountered,third-party participation in the assessment has officially become a national legislative mechanism.Engaging third parties to participate in local post-legislative evaluation can make the legislation more complete and more in line with local realities,and make local post-legislative evaluation activities more fair,open,objective,and scientific,so the construction of third-party participation in local post-legislative evaluation systems is constantly improving One of the effective ways of local legislation in China.Although the current practice of local post-legislative evaluation in China also involves the participation of third parties,it has to be said that the system of third-party participation in local post-legislative evaluation in China has not yet been fully established.Therefore,this article hopes to explore the actual situation of China 's third-party participation in local post-legislative evaluation and the experience of third-party third-party participation in post-legislative evaluation,put forward suggestions to improve China 's third-party participation in post-legislative evaluation,and build a set of socialist localities with Chinese characteristics Third-party evaluation system after legislation.First,in the first part of the article,through the explanation and interpretation of the concept of third-party evaluation after local legislation in our country,as well as the concepts of "third party" and "third-party evaluation",the content of third-party evaluation after participating in local legislation is clarified.It also explains the role andsignificance of the third party's participation in local post-legislative evaluation,and clarifies the theoretical and legal basis for the third party's participation in local post-legislative evaluation.Then,in the second part of the article,it introduces the practice of third-party evaluation in China after the legislation.Through the introduction of specific cases of third-party participation in legislative evaluation in Huainan,Shenzhen,Ningbo,Zhongshan and other cities,the current third-party participation is explained.The status of the post-legislative assessment points out the problems.Then,in the third part of the article,through the investigation of the post-legislative evaluation system outside the region,the relevant situation of the post-legislative evaluation system in the United States,the United Kingdom and Japan is introduced,and the experience of third party participation in their post-legislative evaluation system is explored.Finally,the fourth part of the article,through the actual situation in the practice of the third-party evaluation after the local legislation in our country,combined with the enlightenment from the extra-territorial experience,proposes to improve Institutional conception of third-party evaluation after legislation.
