Research On The Legal System Of Food Safety Supervision Of Online Ordering In China

Under the new situation of "Internet plus",the online ordering industry has developed rapidly.The first three quarters of 2019 took the takeaway trade volume of 603 billion 500 million yuan,and the number of takeaway users was 412 million.With the rich variety of food and convenient distribution,the online ordering became a popular food consumption mode for the majority of consumers.At the same time,due to the complex regulatory links involved in online catering,its food safety is relatively more difficult to ensure,and the food safety incidents in the online ordering industry also occur frequently.General Secretary Xi emphasized clearly that food safety work should always adhere to "the most rigorous standards,the most stringent supervision,the most severe punishment and the most serious accountability".For the food safety problems in the online ordering industry,the "four strictness" principle should also be implemented.The existence of food safety problems not only damages the legitimate rights and interests of online ordering food consumers,but also brings great challenges to the existing legal system of online ordering food safety supervision.Under the virtual condition of the Internet,in order to ensure the safety of online food ordering,it is worth our in-depth study to continue to explore and improve the legal system of online food safety supervision.First of all,this paper introduces the basic concept of online ordering food safety supervision,and analyzes the theoretical basis of online ordering food supervision.Secondly,this paper analyzes the current situation of legislation from the four aspects of the legal system,legal subjects,the responsibilities and obligations of each subject and the law enforcement means of the online ordering food safety supervision,and deeply analyzes the practical problems existing in the online ordering food safety supervision.Thirdly,after summing up the relevant legal systems of the United States,Germany and Japan in the supervision of online ordering food safety,this paper puts forward the experience that can be used for reference to our country.Finally,according to the actual situation of our country,some suggestions are put forward to improve the legal system of food safety supervision of online ordering: first,improve the legal system of food safety supervision of online ordering,such as making supporting implementation rules,enhancing the coordination of laws and regulations related to online ordering;second,improve the legal subjects of food safety supervision of online ordering,such as establishing regulatory agencies The coordination and cooperation mechanism between the agencies should scientifically stipulate the distribution pattern of regulatory forces among the agencies;thirdly,reasonably stipulate the responsibilities and obligations of legal subjects of online ordering food safety supervision,clarify the regulatoryresponsibilities of government departments,and clarify the legal obligations of the third-party platform of online ordering;fourthly,improve the law enforcement means of online ordering food safety supervision,and make full use of intelligent supervision and credit Supervision and whole process retrospective supervision and other means to carry out supervision work.It is hoped that the research of this paper will contribute a little to the improvement of the legal system of online food safety supervision in China.
