The Research On The Legal Issues Of The Old Social Participation Right

Compared with other countries and regions,population aging in China is characterized by a large population base and rapid development.Due to the increasingly serious aging population,it has become an important reason for the frequent social conflicts and disputes occurred in our country,which has seriously hindered the deep development of China's economy and society.Faced with this situation,strengthening the construction of the old social participation and raising their awareness are important ways to solve social problems.The academia has also made active explorations on how to improve and develop the old social participation.This article analyzes and explores the legal problems of the current old social participation based on the theory of the protection of society participation,this author also combines the advantages with disadvantages of the relevant policies issued by the central and local governments.What's more,this author discusses the legal problems existing in the current old social participation about the aging population in China.Above all,a more perfect legal system of the old social participation right is explored.The first chapter carries on the theoretical explanation of the old social participation right.First,it specifically introduces the era,reality,and policy background of the development of the old social participation right;Second,the concept and characteristics of the old social participation are emphasized in this paper,which is also the core of the research.Thirdly,the theoretical origin of the old social participation right is explained in detail from the perspective of human rights;Finally,the paper expounds the significance of protecting the old social participation right from the theoretical and practical perspectivesThe second chapter specifically explains the content of the old social participation right and divides it into political participation right,economic participation right,public welfare participation right as well as organizational participation right.Four kinds of participation rights are demonstrated on the basis of clarifying the basic connotation of the four rights,then the four participation rights are demonstrated and explainedThe third chapter analyzes the current situation of the old social participation right in our country and some places,and points out many problems that exist in the political,economic,public welfare,such as the age discrimination within the old and other groups,their subjective participation consciousness is weak.This paper discusses the lack of equal protection of social participation right and imperfect relief ways for the old.This author analyzes the causes of these problems from the perspective of age discrimination,political and economic systems,specific cultural background,social development constraints as well as other perspectives.In the fourth chapter,on the basis of a deep understanding of the problems and causes of the old social participation right in China,some suggestions are put forward to improve the old social participation right.First of all,we should advocate a concept and awareness to implement the old social participation right.That is,active aging,which guides the construction of the legal system of the old social participation right Finally,this author discusses the concrete practice of legislation,law enforcement and guarantee system as well as supervision and inspection system of the old social participation right,thus the construction and operation of the relevant links are improved.
