Study On The Labor Rights' Protection Of The New Generation Of Migrant Workers

With the development of economy,the traditional migrant workers have been gradually replaced by the new generation of migrant workers.The new generation of migrant workers is the continuation of traditional migrant workers.They are yearning for city and hope to settle in city by their labor.However,constrained by many obstacles,they are suffering many unfair treatments in city.The new generation of migrant workers' awareness of rights' protection is greatly enhanced because of the different growth experience and social environment.Therefore,the labor rights issues they faced have also changed.In addition to the basic labor rights issues like equal employment?wages?holidays and safety,there are many other problems such as the defective legal system,imperfect social security system and so on.Basing on the difficult survival status of the new generation of migrant workers,the paper studies the four most prominent problems they faced at present.The paper discusses the new generation of migrant workers and their labor rights briefly in the first section.In the second section,the three prominent problems at present are analyzed in detail,including defective legal system,infringed work right and imperfect social security system.In the third section,the article selects four foreign countries to study the different measures taken to deal with the land-lost farmers,looking forward to get some useful experience.In the fourth section,the paper will give some relevant suggestions for the three prominent problems faced by the new generation ofmigrant workers' labor rights' protection,hoping to provide some references for China to solve this problems.
