Jurisprudential Analysis Of Student Rights In China’s Postgraduate Scholarship System

As the cradle of national talent cultivation,in universities,what happens or any behavior who makes will play an important role in reflecting the overall style of society.Similarly,the rights consciousness of the students can reflects the general legal consciousness of a specific era to some extent.Among the students,university students are the best embodiment of reflecting the young people’s attitudes towards the right protection issues who have initial thinking consciousness but no social experience.At present,the existing research shows that the deviation of university students’ rights understanding and the lack of right protection are common,but the problems related to student rights between college students and university management are most concentrated in pedagogy,and lack of deep thinking in jurisprudence.At the same time,for the different nature of the exactly behavior during university managing,in order to avoid the contention and the demonstration being dispersed by too many kinds of university management behaviors,national scholarship evaluation for Postgraduates in Chinese Universities was selected as the research object for its openness of rules,legality and transparency of evaluation process make the collection of practical materials easier.Combined with the actual examples,problems of the rights of college students in the implementation of the graduate scholarship system will be analyzed from a legal perspective.This paper is divided into four chapters.The first chapter is an overview of students rights in the national scholarship system for graduate students,mainly introducing the background of the system and the basic situation of students rights in the system.The second chapter summarizes and analyzes the problems related to student rights in practice from the practice survey data of several law schools.The third chapter supplements the analysis of other student rights that may exist in the scholarship system.In the last chapter,it will discuss the current status of student rights relief and then put forward suggestions for improving student rights protection.
