Citizens' enjoyment of the right to education is a fundamental right. Article 46 of the Chinese Constitution clearly stipulates that citizens of the People's Republic of China have the duty as well as the right to receive education. For the minority citizens, the right to education is both civil rights and national rights. To guarantee the realization of this right is very important whether for the country or for the nation itself. Guarantee minority's right to education is the inevitable result for carrying out the national policy and the national legal system. It is also the fundamental requirement for the country's stability and development, a direct reflection of a harmonious society, a necessary means of developing and prospering the national culture, and a basic guarantee of the minority's equal right to survival and development.This paper is based on the theory and supported by the actual suvey data. It applies multi-disciplinary's comparative and analysis , legal notes and other methods into studying the law guarantee of our minority's right to education. So we could make a suggestion on improving the guarantee.This paper started from the general theory of the minority's right to education. First, t discusses its concept, content, features and security significance. Then, it compares and studies the law guarantee of foreign minorities' right to education, ncluding America, Britain and Australia. Meantime, it summarizes the reference's experience and the lessons they have learnd for China. After the investigation of the actual situation in the minorities '( Miao and Tujia's school students)right to education, we sum up the deficiencies through the analysis of survey data. In the end, we make practical suggestions and talk about some measures on the law guarantee's defects of our minorities' right to education.
