| Today’s society is a society with highly developed information and rapid development of network technology.E-commerce industry is showing a trend of prosperity and development,and more and more consumers choose online shopping to meet their daily needs.Under the support of digital background,the personal information of online shopping consumers shows its huge commercial value,which affects the timely and accurate strategic adjustment of e-commerce enterprises in the face of various market changes and challenges.To a large extent,the phenomenon of illegal and improper collection,dissemination and processing of consumer personal information by online shopping merchants,platforms and other operators has become increasingly prominent,which has a great impact on the freedom,rights and legitimate rights and interests of online shopping consumers.In addition,consumers have weak legal awareness,poor concept of rights protection,and inadequate understanding of the importance of personal information security,so they can not take up legal weapons to safeguard their legitimate rights and interests at the first time;in the face of interests,e-commerce practitioners such as e-commerce platforms tend to ignore the information security of consumers,which is not conducive to the long-term development of e-commerce industry.Therefore,we should seek a balance between the personal information security of online shopping consumers and the healthy development of the online shopping market,and explore and solve the problem of infringement of personal information of online shopping consumers.However,there are some problems in the field of online shopping in China,such as legislation needs to be improved,the practicability of legal provisions needs to be improved,and multi-faceted subjects need to work together to protect the personal information security of online shopping consumers.There is no doubt that the establishment of a relatively complete legal system to protect the personal information of online shopping consumers can not only bring convenience for consumers to enjoy online shopping,but also build a good line of defense for their personal information security,which is also the proper meaning of the development of the network economy under the background of the new era system.Therefore,in order to promote the implementation and improvement of the Personal Information Protection Law,this paper studies the legal protection of online shopping consumers’ personal information from the basic national conditions of online shopping consumers’ personal information protection and the judicial cases of infringement on online shopping consumers’ personal information in legal practice,so as to promote online shopping personal information protection and help the development of digital economy.The main content includes the following four parts:First,the basic theoretical research on the legal protection of online shopping consumers’ personal information.Including the related concept,the rationale,the legal protection particularity and the significance analysis.The second is to analyze the damage situation and causes of online shopping consumers’ personal information,study the overall and specific damage situation respectively,and analyze the causes from two aspects of legislation and law implementation.The third is to investigate the legislation of the United States,the European Union and Japan on the protection of personal information of online shopping consumers,and summarize the relevant legislation abroad can be used for reference.The fourth is to put forward some suggestions and countermeasures for the protection of personal information of online shopping consumers in China,with a view to providing feasible and effective basis for judicial practice in the future,and escorting the steady development of online shopping market. |
