Research On The Legal Regulation Of Freedom Of Speech From The Perspective Of Social Co-governance

Nowadays,the Internet affects human life all the time.We have entered the era of News 3.0.The communication platform led by Weibo,We Chat,Post Bar,and Forum,they are the most common We Media in our lives.In the era of “everyone's microphone”,the characteristics of openness,interactivity and anonymity make it considered as a weapon to promote the development of free speech.The degree of freedom between the media and citizens' freedom of speech is increasing,and citizens' right to freedom of speech is taking an unprecedented expansion of the situation.The media likes a double-edged sword,it is precisely because of its advantages of freedom and openness.The unconstrained and random nature of speech publication has caused social conflicts such as online rumors,cyber violence,and network infringement.But regulation cannot be done by a department or an individual.It requires the participation of multiple social entities to regulate it.In view of this,the author proposes the necessary to regulate the freedom of speech from the We Media with the perspective of social co-governance,safeguarding the basic human rights of citizens,while safeguardingthe publicinterestofsocietyandpromoting social harmonyandstability.This article follows the basicideas of asking questions,analyzing problems and solving problems.And it is divided into five parts: First is the introduction,which mainly elaborates the background,significance,ideas,methods and innovation points.The second part gives a detail overview of social co-governance from the perspective of the relevant issues of freedom of speech in the We Media.The third part explores the current situation and existing problems of the legal regulation of freedom of speech in China.The fourth part summarizes and draws on the experience and practice of extraterritorial legal regulation of freedom of speech in the We Media;By drawing on the experience outside the domain,under the guidance of the concept of social co-governance,it proposes the legislative protection such as improving the freedom of speech and freedom from the media,enhancing the operability of the system of accountability for the anomie of the We Media,and establishing and improving the freedom of speech from the We Media.The supervision mechanism,strengthening self-discipline from the media industry,to regulate China's freedom of speech from the We Media comprehensively,to promote the healthy development of China's We Media,and thus guarantee the freedom of Chinese citizens' freedom of speech in the We Media.Conducive to be an harmoniousand developmentsociety.
