China is a large State with a large population and big fishing industry.The marine fishery labor market occupies a large market share.Studying the issue of labor protection in the marine fishery field is conducive to standardizing the order of the marine fishery labor market so as to achieve sound development.Due to the special nature of marine fishery work,especially in small-scale fisheries,the female labor force has long been attached to the field and has not been valued or even recognized.So far,there has been little research on the protection of female workers 'rights in this field.At the end of 2017,the Secretary-General of the United Nations presented the issue of people on the ocean in a special chapter in the report on the oceans and the law of the sea.Among them,the protection of women's rights in the field of marine fisheries was highlighted.It can be seen that this issue has already begun to receive the attention of the international community.The term "women's rights" is actually put forward from the perspective of human rights and protecting human rights have been regarded as the basis of law.Women's rights,as an important component of human rights,include the basic rights that women enjoy as human beings and the special rights that are different from men.As an important part of women's rights,labor rights include the right to employment,the right to choose a job,the right to get a pay,the right to give birth to a child,and the right to special labor protection,etc.In China,the Constitution,the Law on the Protection of Women's Rights and Interests,the Labor Law,the Employment Promotion Law and other laws,the Special Rules on the Labor Protection of Female Employees,as well as the guiding documents such as the Program of China's Women Development,have constructed the current legal system on protecting women's rights.With the development of China's marine fishery industry and the aggravation of marine pollution,the focus of marine fishery industry shows the trend of a shift from marine fishing industry to marine aquaculture industry,which also provides more work opportunities for female workers in this field.Female workers have gradually become an important source of labor.However,due to the condition of working in this field,the level of education of workers and other historical factors,female workers are more likely to suffer from unequal treatment at work,it is necessary to pay more attention to the protection of their rights.Based on the analysis,there are two main problems in the current women's rights protection legal system,on one hand,international human rights law needs to be transformed and then be applied,but the current domestic human rights legislation is not enough.On the other hand,the relevant labor laws and regulations may not be able to protect some female workers in small-scale marine fisheries due to the unqualified subject,and only the protection of Civil Law is limited.Therefore,through the analysis of the evolution of composition of the marine fishery labor force,the development of women's rights and the current laws and regulations of women's rights protection,the necessity of strengthening the legal protection of women workers in marine fisheries is demonstrated.At last,through the combination of legislative precedents that can be used for reference from some northern European fishery powers and the legislative practice of law on protecting women's rights in China,the author tries to put forward feasible measures to strengthen the protection of female labor force in the field of marine fishery.
