Research On Consumers' Right Of Withdrawal In Online Transactions

This paper analyzes the legislation and current implementation situation of consumers'right of withdrawal in online transactions in recent years,and finds that the system has many problems and disputes in terms of the definition of rights subjects,applicable standards,and applicable scope.Comparing the legislation and practices of consumers' right of withdrawal in the United Kingdom,the United States,the European Union,and Germany with a long history and perfect legal system,we can find that these countries adopt typed enumeration on the scope of application of the right of withdrawal,and use a combination of text and behavior in the practice of the right of withdrawal.The above approaches are all worthy of reference for our country.For this reason,from the perspective of balancing the interests of both operators and consumers,based on China's reality and learning from foreign experience,China should improve the withdrawal right system from these aspects.First,define the concepts of consumers and operators clearly.Second,improve the abuse of the right of withdrawal by establishing a consumer credit evaluation mechanism.Third,define the scope of application of the right of withdrawal from the perspective of the nature of the product and the type of transaction.Fourth,according to the characteristics of the commodity,prescribe different withdrawal rights periods and standards of product integrity.Finally,through improving the freight insurance system by cooperating with insurance companies,we can achieve full coverage of freight insurance for online shopping products and solve the problem of freight sharing.
