On The Improvement Of The Legal Guarantee System Of Villager Autonomy In Ethnic Areas

ii As the basic governance system implemented in the grass-roots rural areas,thevillagers' autonomy system has promoted the great development of the political economy of the grass-roots rural areas in China since its implementation.In recent years,with the development of rural society,a new system of rural governance is being established.As the foundation of rural governance system,it is of great significance to improve the legal system to ensure the effective implementation of villager autonomy.In addition to the problems existing in the legal guarantee system of villagers' autonomy,it is necessary to pay more attention to the special ethnic character of ethnic minority areas,including minority languages,ethnic customs,religious taboos,customary laws and preferential policies given to ethnic minorities by the state,etc.Therefore,the implementation of villager autonomy in ethnic areas needs to be combined with the rural particularity of ethnic areas and the latest national policy system to further improve the relevant legal protection provisions.Through a large number of reading literature from many aspects of the use of comparative analysis and other methods to the existing ethnic areas villagers autonomy legal security system and its gaps in in-depth analysis,and then to find solutions and methods.In the first part,it analyzes the noumenon of villager autonomy and the particularity of villager autonomy in ethnic areas.The basic connotation and extension of villagers' autonomy and the particularity of villagers' autonomy in ethnic areas are further clarified through analysis.The second part analyzes the legal guarantee basis of villagers' autonomy in existing ethnic areas.From the aspects of freedom,order and efficiency,this paper analyzes the legislative value orientation to ensure the implementation of villagers' autonomy in ethnic areas.Then the laws and regulations on the implementation of villagers' autonomy and the specific implementation measures issued by ethnic areas are deeply analyzed.The third part,according to the present situation analysis of the existing laws and regulations,found the difficulties in the implementation of villager autonomy in ethnic areas,including the main body of autonomy,democratic supervision,democratic decision-making and other provisions are not clear and lack of special provisions for ethnic areas.The fourth part,on the basis of analyzing the difficult situation of legal guarantee of villagers' autonomy in ethnic areas of our country,puts forward the corresponding ways to perfect,including: clarifying the status of the main body of villagers' autonomy,perfecting the specific legal provisions to guarantee the relevant villagers' autonomy meetings,perfecting the democratic supervision system and making special provisions according to the particularity of ethnic areas.Through the above discussion,it is intended to explore the perfection of the legal guarantee system of villagers' autonomy in ethnic areas,and promote the harmonious society and the rule of law society in the local villages of our country to develop in depth.
