Research On Optimization Of Policies On Rescue By Children Of Incarcerated Parents From The Perspective Of Cooperative Governance Theory

The juvenile children of prisoners are the most complicated group of children in difficulties in China.The juvenile children of prisoners should enjoy the same basic rights as other children,but because their parents cannot normally fulfill the responsibility of raising and guardianship due to their crimes,the orphans who are not legally defined have become "DE facto orphans".They are faced with a series of problems,such as the pain of orphans,economic distress,social discrimination,stigma,lack of legal security and lack of social security,leading to the plight of juvenile children of prisoners.As a special group of marginal groups,inmates minor children vulnerable to sentence the parents and the influence of psychological problems and behavior deviation,if not for these minors early deviant behavior for effective prevention and control,it is possible to change to criminal behavior,form harm social stability important hidden danger.In this context,it is particularly important to do a good job in the relief work of juvenile children of prisoners,and reasonable optimization of the policy is the premise of effective relief work.In July 2019,the Ministry of Civil Affairs,the Supreme People's Court,the Supreme People's Procuratorate,Ministry of Education,Ministry of Public Security,Ministry of Finance,such as 12 departments jointly issued by the "about further strengthens the fact no one raising children security work opinion"(no.62 [2019] of the state)let inmates minor children this group to attract the public attention again,how to optimize the inmates minor children relief policy ponder.The main body of this paper is divided into six parts: the first part,mainly is the introduction,focusing on the realistic background,significance and purpose of the research,the literature review,the research ideas and methods of this paper.The second part mainly defines the meaning of the policy system of assistance for the juvenile children of prisoners,juvenile children of prisoners and juvenile children of prisoners,reviews the theory of collaborative governance and the theory of children's rights,and lays a theoretical foundation for this study.The third part expounds the policy system of juvenile children assistance for prisoners,and analyzes its policy objectives to guarantee the juvenile children's rights to survival,education,family growth and protection.In the fourth part,the author expounds that under the protection of the relief policy,the juvenile children of prisoners still have such phenomena as no guarantee of life,deprived of the right to education,alienation of parent-child relationship and social discrimination.The fifth part,from the multi subject to illustrate the inmates minor children relief policy practice,analysis of the inmates minor children relief assistance system that exist in the division,"Shu Xie Shi" single relief way,such as "implementing public assistance program,assistance" fair realistic predicament,and analyzes the reason for this is due to the policy "fragmentation",on the not perfect.Chapter six,the focus of the relevant countermeasures.From the policy formulation,policy implementation,policy evaluation,policy monitoring and other aspects,combined with the theory of collaborative governance,put forward optimized policies.
