Research On The Evaluation Standard Of Administrative Rules After Legislation

In legislation,administrative rules are the most numerous text types.In law enforcement practice,rules are often the most commonly used and the most frequently used basis for law enforcement.Therefore,the legislative quality and implementation effect of administrative rules are closely related to the level of government administration according to law.At present,although there are many domestic research results on the related issues of post legislative evaluation in the overall sense and the related issues of local post legislative evaluation,there are few comprehensive and systematic research results on the standards of post legislative evaluation of administrative regulations in China.There is a lack of in-depth analysis on the evaluation criteria.On the one hand,there is less research on the reflection,sorting and summary of the evaluation criteria after the administrative rules have been carried out to test the effect of the application of the evaluation criteria after the administrative rules have been legislated;on the other hand,there is no targeted application of the evaluation criteria after the legislation according to the different characteristics of the contents of the administrative rules The application effect of the standard needs to be improved.In addition,the research results of administrative regulations and the research results of post legislation evaluation,two special topics are independent,lack of effective connection and communication between each other,can not effectively promote the improvement and development of post legislation evaluation standards of administrative regulations in China.In view of the problems and research status,it is necessary to integrate the existing research results and carry out specialized systematic research.In the structure,this paper is divided into five parts,the first part is the introduction part,which introduces the basic situation of this paper.The second part,mainly using the method of literature analysis,combined with the research situation of the existing works and papers,expounds the general theory of the evaluation standard after the legislation of administrative regulations,including the theoretical analysis,influencing factors and selection principles of the evaluation standard after the legislation of administrative regulations,as the theoretical basis.The third part,using the method of empirical analysis,expounds: in the aspect of text regulation,statistics the post legislation evaluation standard of administrative regulations in the text regulation,data analysis,and analysis of the problems;in the aspect of practical application,analysis the problems in the practice of the post legislation evaluation standard of administrative regulations.The fourth part,in view of the problems existing in the legislation and practice of the post legislation evaluation standard of administrative regulations,based on the investigation of the current situation and the analysis of the shortcomings of our country,puts forward specific measures to improve the post legislation evaluation standard of administrative regulations from three aspects: refining the connotation of the evaluation standard,improving the pertinence of the application of the evaluation standard and improving the application effect of the evaluation standard.
