Post-legislation Evaluation Study Of The Regulations On The Protection And Management Of Puzhehei Scenic Spot In Wenshan Zhuang And Miao Autonomous Prefecture, Yunnan Province

Under the background of comprehensively improving the quality of legislation,this paper makes a post legislative evaluation study on the regulations on the protection and management of Puzhehei scenic spot in Wenshan Zhuang and Miao Autonomous Prefecture(hereinafter referred to as the regulations on protection and management).Through the evaluation of the text quality and the implementation effect of the main systems of the protection and administration regulations,this paper provides a theoretical basis for considering whether the protection and administration regulations need to be revised and improved.At the same time,in view of the problems existing in the implementation of the regulations on protection and management,combined with the development characteristics of scenic spots in Yunnan Province,this paper puts forward some suggestions on the revision of the regulations from the aspects of scenic spot protection,scenic spot management,scenic spot development and utilization,so as to provide reference for the relevant departments to formulate and revise the local regulations on traditional Chinese medicine,and promote the sustainable development of scenic spot tourism in Yunnan Province.First of all,through data collection,literature research and other methods to comprehensively obtain the existing academic literature on the construction of local legal system of scenic spots,through the systematic combing of the existing scenic spot protection and management policies,to understand the current situation of the construction of local scenic spot protection and management.Secondly,using expert interviews,empirical research and other methods to establish the "protection and management regulations" after legislation evaluation index system,and using analytic hierarchy process to calculate the weight of each index.Furthermore,according to the established post legislative evaluation index system,the paper evaluates the text quality and implementation effect of the protection and management regulations,and analyzes and summarizes the problems existing since the implementation of the protection and management regulations.Finally,based on the results of text quality evaluation and implementation effect evaluation,combined with the existing problems of scenic spots and the needs of legal construction of different scenic spots,this paper puts forward some suggestions on the revision of the protection and management regulations.In terms of text quality evaluation,the protection and management regulations are legal,normative and good,but in terms of rationality and Operability,the overall evaluation is low.In terms of the evaluation of the implementation effect of the main system,the implementation of the protection and management regulations provides legal guarantee for the protection and management development of scenic spots in Wenshan Prefecture,and promotes the development of the development and utilization of scenic spots in Wenshan Prefecture.However,some problems are also found in the evaluation,mainly due to the possible existence of local protectionism in the provisions and the lack of operability in funeral management Strong questions.According to the results of the post legislative evaluation feedback,this paper holds that the formulation and revision of laws and regulations should conform to the principles of legality,rationality,coordination,operability,characteristics and standardization,that is,the legislative procedure is legitimate,the main system is reasonable,it does not conflict with the upper law,the content is specific and operable,the local characteristics are highlighted,the language is accurate and standardized,and it meets the local legislative standards.In addition,the specific suggestions for the amendment of the protection and administration regulations are as follows: firstly,the wording of the regulations should be standardized;secondly,some parts of the protection and administration regulations should be amended to avoid the emergence of local protectionism;thirdly,the in-depth study of funeral issues should be conducted to seek more scientific and reasonable solutions to avoid social conflicts.
