Research On Post-evaluation System Of Major Administratrative Decision-making In China

Major administrative decision-making involves a wide range of interests and has a great impact on the economic development and people's production and life in a certain administrative region.The decision on strengthening the administration by law of municipal and county governments,issued by the State Council,put forward for the first time the establishment of a "post-evaluation system for the implementation of major administrative decisions".Since then,in order to improve the quality of major administrative decision-making,standardize the procedures of major administrative decision-making,and prevent and reduce the occurrence of illegal decision-making,the "Provisional Regulations on the procedures of major administrative decision-making" has made provisions for the post-evaluation system of major administrative decision-making.However,the provisions of the regulation are too principled,the operability is not strong,the scope of the assessment is not clear,the initiating subject of the post-assessment is unreasonable,the assessment subject is single,the assessment content is not comprehensive,the assessment method is not perfect,and the assessment procedure is not perfect,deficiencies in the effectiveness of evaluation reports.Therefore,this paper analyzes the legislative status of the post-evaluation system of major administrative decisions,and draws on the advanced experience of foreign relevantsystems,by using the research methods of normative analysis,empirical analysis and comparative analysis,this paper puts forward some legislative and practical suggestions for the post-evaluation system of major administrative decisions in China,suggestions for legislative improvement include reasonably determining the scope of post-assessment from three aspects: the Implementation Period of major administrative decisions,the degree of satisfaction of citizens and other changes in objective conditions;The same level of supervision to reasonably determine the People's Congress;from the internal and external evaluation to participate in the evaluation activities,to determine the diversity of evaluation subjects;The content of the post-evaluation is detailed from the aspects of legitimacy,necessity,rationality,implementation status and technicality,and the methods of the post-evaluation are perfected from two aspects of obtaining information and analyzing information The post-evaluation start-up phase should be integrated into the evaluation process,and the effectiveness of the post-evaluation report should be improved in terms of providing the basis for decision-making adjustment and holding the responsible persons accountable.The suggestions for improvement in practice include strengthening the awareness of post-assessment staff on post-assessment activities,improving their professionalism,establishing a system of accountability and implementing the responsibility of post-assessment staff,with a view to enhancing the operational nature of the system in practice,to enhance the ability and level of the executive branch to make decisions according to law.
