Study On The Non-litigation Mediation Mechanism Of The Western Rural Of Our Country

Contradictions and disputes always accompany the development of human society.In the process of constantly exploring and seeking solutions to these contradictions and disputes,man have gradually formed a number of effective methods,such as reconciliation,mediation,litigation and so on.Among them,non-litigation mediation has played an important role in settling disputes in the dynamic process of human social development.Although there are some differences in terms between ancient and modern Chinese and foreign countries,its institutional function and ultimate goal are the same,both aim at solving civil disputes and resolving civil conflicts,so as to maintain social order and harmony.China's rural areas are vast,and different rural areas have great different in economic development level and history and culture.In the vernacular as the foundation of rural society,its customs and the local rules are the most obvious and the most profound.The division of our country into east,middle and west three parts by China's National Bureau of Statistics statistical subject of our country.The east generally refers to the developed coastal areas;the west generally includes the northwest and southwest regions;and the central part is other regions.China's eastern region has a well-developed economy,a large number of cities,a more densely populated population,and a fast-growing economy,convenient transportation and other convenient conditions for the eastern coastal areas of rural areas.While the central and western regions are vast in region,the level of economic development is far behind that of the eastern region,and the main sources of income of rural farmers in the central and western regions are farming and migrant workers,especially true in the western rural areas.The economic development of the rural areas in western China is relatively backward,ideology is conservative,accept ability of new things such as the rule of law is also obviously lags behind the urban areas and the eastern region,so most civil disputes the continuation of the traditional rural folk habits,namely to non-legal dispute settlement,among them,and to resolve disputes in non-litigation mediation way the majority.At the same time,because of the influence of the modern rule of law culture,non-litigation mediation way also had the very big change in the content and form,for the contemporary social contradiction resolve provides a feasible path.Non-litigation mediation for the western rural areas of China settling disputes and reconciling contradiction has played a very important role,but it also presents some disadvantages in the process of the applicable,such as system implementation does not reach the designated position and system connection problem and so on.So,in this paper,the rural areas of west China way of non-litigation settlement were discussed,in order to clarify the advantages and disadvantages,the advantages should be used,and the disadvantages should be changed: the change of way is pointed out that the non-litigation mediation in the current problems existing in the practice,and the improving suggestions for its improvement.
