In 2019,the supreme people's procuratorate formulated and issued the procuratorial reform work plan for the period of 2018-2022,proposing to "deepen the work of rehabilitating and rehabilitating juveniles involved in crimes,and explore the establishment of critical prevention,family education,classification and punishment and protection systems for juveniles who commit crimes." In April 2020,the supreme people's procuratorate's opinions on strengthening the procuratorial work of minors in the new era stated:"promote the establishment of a hierarchical intervention system for juvenile delinquency.Strengthen cooperate with public security,education and other functional departments of the cooperation,establish and improve the serious bad behavior,not for criminal responsibility age the criminal punishment of minors information exchange,clues transfer and early intervention mechanism,promote perfect offence critical prevention,family education,to protect minors punishment such as organic link of grading system of intervention." Therefore,it is imperative to construct the classification system of juvenile delinquency.To study the present situation of juvenile delinquency treatment in China,analyze the necessity and feasibility of grading juvenile delinquency treatment in China,and put forward the concept and system design that should be adopted in grading juvenile delinquency treatment,which is of practical significance to the establishment of grading juvenile delinquency treatment system.The classification of juvenile delinquency includes preventive measures and sanctions against juvenile delinquency.At present,when the vicious crime of minors happens from time to time,according to the criminal law,the protection law of minors,the law on prevention of juvenile delinquency,the law on public security management and punishment and other laws and regulations,it is impossible to completely regulate the wrong behavior of minors.There are some problems in the punishment of juvenile delinquency in our country,such as unclear responsibility subject and unreasonable classification standard.Encounter measures has realistic plight in the judicial practice,criminal treatment such as imprisonment,community correction effect is not ideal,the weakening of decriminalization processing way,being firm order cannot be effective implementation,for reeducation system function cannot be achieved,the work-and-study schools effect is hard to play,effectively supporting system construction is not complete.Minor offence behavior classification is compatible to the place of the particularity of juvenile justice,is the inevitable choice of minors vicious crime,and hierarchical place in juvenile conform to the trend of the development of the juvenile justice,especially outside the United States,Germany,France and Japan's experience is a minor offence behavior classification place provides the feasibility.So to science to construct our country minor offence behavior classification of concept and system,the concept should be implemented on the protection of education idea,the introduction of "malicious complement age rule",the system design should be integrated hierarchical place of responsibility main body,set the scientific classification standard,to set up the implementation of specialized agencies,optimization of measures.
